23. Richard Pinner demandeth of John Abbott Admrator of Capt John Boteler three hundred wt tob, due for 6. weeks service from the said Jo: Boteler. summons to sheriff Kent, to warne deft to answere febr: next, vniesse there be a Court held at Kent afore; return cod:
22 the second answere And the said G. B. saith that the said bill is of Mr Brentvncertaine & insufficient to require to be
answered vnto, in regard that by its forme it appeares not whether it be a prosequution civill or criminail, nor con sequently will it perrnitt him to make vse (as proper for his answere) of such pleas & advantages as the Law allowes him severally according to the nature of the cause; and if it be intended to charge him only criminally, then for plea he saith that lie is not guilty of any contempt or misdemrs nor in manner & forme as is supposed by the bill, and for triall thereof he putteth himselfe vpon his country. And if it be intended to charge him also civilly for damage, then for answere he denyeth himselfe to have indamaged the province as it is laid to his charge in the bill, and for triall thereof he putteth him selfe vpon his country. signed Giles Brent
