          Court and Testamentary Business, 1644. 281

     

      vpon the pett for it; humbly therefore prayeth to attach the                        Liber P. R.

      goods of the said Philip white to that value till he putt in

      security to save the petr harmles from his said bond. Sheriff

      returnd that he hath attached a debt of 4500 l tob & cask in

      the Captaines hand.

        warrt to sheriff to attach debts or goods of Philip white, till

      he putt in security to save harmelesse the said Anth. hodgkins.

     

        26 Came Philip white mariner, and sheweth that he is

      not bound to Capt Gibbon or mr Alderton in any somme of

      pork absolutely, but either in so much pork or so much

      tob wch shall amount to 20 l sterle at the rate of 4d pl wch is

      but 1 200 l tob. and that the said Anth. hodgkins did assume

      at this defts last going for Engl: to satisfie the said bill,

      & hath received of the deft sufficient value therefore; & that

      therefore the action of the said Anth. is a meere vniust moles

      taon: & therefore prayeth the attachmt to be released.

      satisfie damage to deft.

     

      June 3d 1644

        Seise into your hands all debts goods or chattells wch you

      shall find within yor County due or apperteining to william Clay-

      borne late of Kent Esq who stands by publique acts convicted

      of open hostility done & exercised within this province against

      the Lord Proprietary & his goverrnt And what you shall so

      seise deliver into the hands of his Lops Receivor grall. for wch

      doing this shalbe your warrant.

      To the Sheriff of Kent            Giles Brent

     

        July 1 2. John halfhead acknowledgeth himselfe to owe

      1000 l tob to the Lord Proprietary in case he shall not be at the

      next Court on the first of october, to give evidence agst Edw.
