    any more expeditious way; for the Service of his Maty and Lib. H. D.

    benefit of the Parties concernd whereby the sd Ship might be

    brought to tryall, who makes answer he can not.   p. 448

     To his Exncy ffrancis Nicholson Esqr Capt Genll & Governr

    of Maryl.

     The humble Peticon of Richard Bass Master of the Ship

    Charles of Topsham now Riding in South River & under

    Seizure for some supposed breaches agt the Acts of Trade

    and Navigation.

    Pet, of  Sheweth that the     Ship upon the 30th day of

    Richd Bass December last was Seized by Thomas Collyer an Whitehall

    Charles of Officer undr yor EXnCY and that by information of one

  Topsham  Gabriell Parrot that She has brought in some goods

           contrary to Act of Parliamt as alsoe (being an unfree

    bottom) that She is uncapable of Trading into this Province;

    the former of wch allegacons is Utterly ifalse; and the latter as

    yor Peticönr is advised, and is ready to make appear, in no

    wise Sufficient to give yor Peticonr this molestation.

      That yor Petitionr lyes at great Charge, and if his sd Ship

    be not brought to a Speedy Tryall for the sd Supposed

    breaches, shall loose the opportunity of Sayling with the

    Convoy whereby not only yor Petitionrs Owners will be con

    siderable loosers but likewise his Maty loose at least the

    Sume of 4000 ll Sterl. wch will be his due for Custom upon

    Landing her loading in Engi. wherefore

      Yor Peticonr humbly Prays that in Consideracön of the

    prmises yor Exncy out of yor wonted goodness, and tenderness

    to Traders as well as out of yor Zeal for promoteing his Matys

    interest will please to Appoint Speciall Commissionrs and that

    with all the Speed yor Exacy Can with Convenience for Tryall

    of the sd Supposed Breaches, that yor Peticonr may know the

    issue of the matter;

                   And as in Duty bound he will Pray

    The Kings lye read and perused the Statute of Westminster Whitehall

     the Second, and my Lord Cokes comments thereon,

           and upon consideracon of the whole, I am of

    Opinion that a Commission of Oyer and Terminer cannot in

    this Case be Granted.
