      A Second Peticon of Wm Sharps Preferr'd to this Board

     and Read as followes Vizt

    

    

     To his Exncy the Governr & to the honrble the Councill.

                 The Petition of Wm Sharp.

     Mr Wm d Humbly Sheweth.

          pet. That your Petitionr was advised by his Counsell

     Reference to to Sue a Writ of Error upon a Certain Judgment

    the Kings Lawyers.   obtain'd against him by George Plater Esq

             Attorney Genll who in behalf of our Lord the

     King Prosecuted for 1000 ll Sterl. and yor Peticonr accordingly

     Enter'd into Bond with two other persons his Sureties for the

     prosecuting the sd Writt of Error with Effect before yor EXnCY

     and this honrble Board but the Clerk of the Chancery instead

     of making the Writt of Error upon the Judgmt obtain'd

     against yor Peticonr by George Plater &Ca made out the sd

     Writt upon a Judgmt Supposed agt yor Peticonr to be had by

     our Lord the King not mentioning the sd Plater, and yor

     Peticonr being taken in Execution and thereby Restrained of

     his liberty to his great loss and Damage.

      Yor Peticonr humbly beseeches yor Exncy and this honrble

     Board that he may be admitted to purchase a New Writt of

     Error returnable before yor Exncy the next term and that

     fforasmuch as he cannot procure any new Security that the

     fformer Security may be accepted and that in ffavour of his

     liberty he may not be detain'd any longer in Prison for the p. 496

     ifault of a Clerk only,

                       And yor Peticonr will Pray &ca

    

      Yor Petr also Prays that he may have the Order of this

     Board that the Chancellr may not have any ffees for the Second

     Writt of Error nor he be Compelled to pay ffees to the

     Sherriff for his Imprisonmt.

      The sd Peticon was by Ordr indorsed as follows Vizt

    

    

      By his Exncy the Governr & Councill &ca June 10th 1697

      Ordered that the within Peticon be Referred to Mr Attorney

     & Sollicitor Genll for them to make Report, their Opinion

     therein; but this Board make Answer that they in no wise

     approve of the Security they both lying under Severall

     Engagemts already.
