Journal.

Ordered by his Excellcy the Governour & Council that the
said Vestry do apply what Tobo they have in their Hands be-
longing to the Parish in building a pretty convenient House
and purchasing a Glebe for the Minister & his successors
Came Col Dorsey Major Greenberry Capt Draper and Mr
Baker from the House with the following message

By the House of Delegates June 26th 1702

The Message of this Day by Col John Hammond and other
Gentlemen of the Honble Council relating to the Matter pro-
posed for an Allowance to Col Thos Smithson chief Justice of
the Provincial Court was here received and read, and the
house thereupon resolved into a grand Committee to debate
the same The Committee having made choice of Major Wil-
liam Dent their chairman and fully considered & debated the
whole matter in the message contained, and so dissolved ;
Mr Speaker again taking the Chair Major William Dent
reported the resolves of the Committee as follows
1 That the said Col. Smithson is a Person in all respects
Qualified for that office of chief Justice & has deserved not
only in that but in other Matters very well of this Province &
is well worthy of a Consideration for the same
2dly We never understood that any Country or Province
has payed any Judge or Justices Sallary except defraying their
charges, but such Charges have been always defrayed out of .
his Majesty's Revenue
3 For which causes we cannot think to lay any Burthen on
the publick to raise such Salary as is proposed
To all which this House Concurrs

Sent to the House by Col Lloyd and Mr Sanders

Ordered that George Muschamp Esqr her Majesty's Re-
ceiver of the District of Potowmack & Pocomoke pay unto
Col John Bigger out of the 3d p Hhd for Arms what he dis-
bursed for cleansing mending & fixing the publick Arms in
Calvert County 14 pds nine shill.
Ordered that George Muschamp Esqr Receiver as afsd pay
unto Charles Kilburn out of the sd Duty of 3d p Hhd six pds
for his extraordinary Care and pains in looking after firing &
scaling the Gunns on the Stadt House Hill
