sent them to Acquaint his Exncy that their Speaker being
indisposed they Desired his Exncys Directions if they should
Choose another Speaker to whom his Exncy was pleased to say
he was much Concerned for Col Smith's Indisposition, But
that he and her Majesty's honble Councill having observed his
Good Conduct especially in the last Assembly thought it
Adviseable Especially in Reguard that his Exncy is acquainted
the said Col Smith Designs to be here to morrow further to
prorogue the Assembly untill to morrow and therefore would
order a Writt of prorogation to that purpose Accordingly
the said Writt being prepared and sealed with the Great
Seale was published by beat of Drum and thereby the Gen-
erall Assembly stands prorogued till Thursday the Seaven-
teenth Instant.
Came Mr Thomas Boardley Clk of the Secretarys and made
oath that he had Examined the Laws of the two last Sessions
of Assembly by him recorded in the Secrys Office.

Thursday May 17th 1705

The Councill in Assembly pursuant to her Matys Writt of
prorogation of Yesterdays Date mett & Sate prsent.

His Exncy the Govr &c.

Thomas Tench Esqr Col Edward Lloyd
Coll John Addison Lt Coll Wm Holland
Thomas Brooke Esqr James Sanders Esqr
Robert Smith Esqr Kenelm Cheseldyne Esqr
Col John Hamond Col Thomas Ennalls.

Majr Lowe and three other Members from the house to
Acquaint his Exncy of their being mett and Waited his
Comands.

Mr Smith and Mr Sanders sent to the house of Delegates
to Acquaint them his Exncy is Ready to Receive them &
Comands Mr Speaker & the Members of the house to attend
him in Councill

Came Mr Speaker and the Members of the house of Dell
to Attend his Exncy to whom he was pleased to speak as foll.
viz. Mr Speaker and you Gentlemen Dellegates

Tis very Evident the Treasonable villanous practices of some
Amongst us has encouraged the Indians to Comitt their Bar-
baritys on our fellow Subjects :

Those by their ffrequent Insolencys have put the Country
to the Trouble and Charge of keeping men out to protect the
honest painfull Inhabitants on that frontier : one great motive
these Bold Incendiarys used to Inflame the unthinking Crew
(Who were to Joyne in Concert with'em) was our Naked-
