of the former Sheriffe, was deliuered to him as the Subsequent
Sheriffe.
And it appearing to the Court, th^t the Estate of Co^tt Yardley was
conueyed out of the prouince in M^r Symon Ouerzees Sloope. It is
ordered th^t this Cause bee respited till the next Prouinciall Court, &
th^t M^r Ouerzee being p^ent, make answere to this demand.
The Deposⁿ of Thomas Haruey aged 24 yeares or thereabouts
taken the 7^th day of Septemb^r 1658, Sayth, That in the month of
May last hee went by the Order of Tho: Cornewalleys Esq^r w^th his
sloope to Richard Wattson for a hogshead of Tob, to carry it aboard
the White angell, & the s^d Wattson would not lett him haue it, &
further sayth not.

John Grimley aged 31 yeares or thereabouts sworne & examined,
Sayth That hee being att the howse of Richard Wattson, When M^r
Abington Seruant to Cap^t Cornwalleys came w^th Zacharias Wade to
the howse of Richard Wattson to looke uppon one hogshead of Tob,
w^ch had beene formerly receiued by the s^d Abington, & had layne
there most part of one yeare, The s^d Abington desyred Richard Watt-
son in case th^t Cap^t Cornewalleys did send for the Tob. th^t hee would
lett them haue it. Whereuppon the s^d Wattson replyed, in case th^t
Cap^t Cornewalleys would make him paym^t for the howse roome of it,
hee would lett it goe, & the s^d Wattson desyred Abington to acquaint
Cap^t Cornewalleys w^th it, W^ch s^d words were past betwixt them in
January last, & ffurther sayth not.

Thomas Lomax aged 28 yeares sworne & examined this 2^d of
Octob^r 1658 Sayth That in May last this Depon^t being att the howse
of Richard Wattson, when Two men came from M^r Ouerzees Sloope,
& told the s^d Wattson they were desyred to call for one hogshead of
Tob, th^t lay att the s^d Wattson's howse, W^ch s^d Tob. belonged to Cap^t
Cornewalleys, Whereuppon Wattson did aske them, if they had any
Note to testify from Cap^t Cornewalleys his hand. They sayd noe.
Whereuppon the s^d Wattson desyred them to tell Cap^t Cornewalleys,
that he would not deteyne the Tob from the s^d Cap^t Cornewalleys, or
any other, th^t had Order to shew for it: Prouided th^t the s^d Wattson
had fowrty nine pownds of Tob for the howseroome of it. W^ch
message the s^d Wattson had formerly sent to Cap^t Cornewalleys, by
his seruant M^r Abington & further sayth not.
