260 Provincial Court Proceedings, 1676. Liber N N to ye within named William Dare in ye prsence of us after the Said Bayly was discharged from ye Sheriffe J arvis Ballard: Henry Everard: John Russall The elaventh of Aprill 1676 Proued by the Aboue written Jarvis Ballard & Henry Everard in open Court & yt the said Richard Bayley as far as they Know was at liberty no Sheriffe being then prsent with him at the Sign- ing & Sealeing the Same Jno Blomfeild Cl Cur Provint p. 162 Robert Ridgely Wm Russell late of Ann Arundell County planter agt otherwise called William Russell of Ann Arundel Wm RussellCounty Inholder was sumoned to answer unto Robert Ridgely One of the Attornyes of the Pro vinciall Court according to the libertyes and priviledges &c allowed of a plea that he render unto him the full and just summe of two thousand pounds of good Sound merchantable tobacco & caske which to him he oweth and unjustly deteineth And whereupon the Said Robert Ridgely in his proper person Saith that whereas the said Wm the 29th day of October 1674 by his certaine bill Obligatory Sealed with the Seale of him the Said Wm and here in Court produced whose date is the day & yeare afore- said did acknowledge himselfe to be holden & firmly indebted unto the said Robert in the full & just Summe of two thousand pounds of good sound merchantable tobacco & casque To be paid to the Said Robert Ridgely or to his certaine Attorny his heirs executrs admrs or assignes at Some convenient place in the said County upon demand To the which payment well and truly to be made the said Wm did bind himselfe his heirs executes & admrs firmly by those presents not- withstanding which the said Wm Russell the said summe of two thousand pounds of tobacco to him the said Robert Ridgely accord- ing to the tenor of the said writeing Obligatory though often there- unto required hath not paid but the same to pay hath denyed and as yet doth deny whereupon the said Robert Saith he is dampnified & hath lost to the value of three thousand pounds of tobacco & there- upon he bringeth his Suite. And the said Wm Russell by George Parker his Attorny cometh and defendeth the force & injury when &c and prayeth liberty to imparle hereunto untill the next Provinciall Court and it is granted him the same day is given to the said Robert. Now here at this day to witt the tenth day of April in the first yeare of the Dominion of Charles Lord Baltemore &c Annoq Dom 1676 Came the said Robert Ridgely in his proper person and the said Wm Russell by his said Attorny came also and the said Wm Saith nothing in barr or avoidance of the action aforesaid of him the said Robert in forme aforesaid brought whereupon the said Robert remaineth against the said Wm thereof wholly undefended |
