64 Provincial Court Proceedings, 1679.

house of the next Genll Assembly, that the same might be then
argued; which the Court was then pleased to grant. yor peticonr give-
ing such security for prosecuteing the same as the Honble the Chan-
celour should like & approve of. In obedience & pursuance to which
order y o' peticuii* did giuc sudi secuiily, all which may appeare by a
copy of the order of Court & the Chancelours Certificate hereunto
annexed. The prmisses considered yor petr doth humbly begg an
order of yor Lordpp & Honble Councell to his Honor the secretary
for the issueing forth of a writt of Error & supersedeas of the judg-
ment aforesaid to be argued before the upper house att the next Genll
Assembly according to the above order And as in duty bound he
shall pray &c.

This peticon referred to the consideracon of the Justices of the
Provintiall Court in Court sitting,

Afterwards to witt the thirteenth day of Octobr in the fourth
yeare of the Dominion of the right Honble Charles Lord Baltemore
&c Annoq Doni 1679 the aforesaid peticon being read & heard, And
George Parker Attorney for the said Henry Stocket And Robert
Carvile Attorney for the said Robert Peca being present in Court
Itt is ordered that the said Henry Stocket have a supersedeas & writt
of Error of the judgmt aforesaid, he giveing security to prosecute
the same according to Act of Assembly Whereupon came the said
Henry Stocket with Wm Burges & John Stanesby his suerties And
the said Wm & John did acknowledge themselves to owe unto the
said Robert Peca the sume of Eighteen thousand foure hundred &
twelve pounds of tobacco to be leavyed of their Goods & Chattles
lands & tenements to the use of the said Robert Peca, in case the said
Henry Stocket shall not prosecute his writt of Error before the
upper house att the next Genll Assembly against the said Robert Peca
with effect And also satisfie & pay (if the aforesaid judgmt shall
be affirmed all & singuler the debts damages & costs adjudged or to
be adjudged upon the former judgmt And all costs & damages also
to be Awarded for the delaying of Execution, Unlesse the said
Henry Stocket shall pay the same, or render his body to prison

By vertue of a Comission bearing date the seventh
day of June in the fourth yeare of the Dominion
of the right Honble Charles &c Annoq Doni 1679
to us John ILewellin & Thomas Lomax of the

County of St Maryes directed, thereby Authoriseing & appointing
us to Audite State & examine the accompts betweene Henry Brayne
& Justinian Gerard wee the said John ILewellin & Thomas Lomax
haveing accordingly mett this twentieth day of August Anno 1679
