In Council February 12 1789

By the Petition of Thomas Bailey of Baltimore town in Baltimore
County, Constable, accompanied by transcripts of the proceedings
therein mentioned, it appears that he was fined by the Court of Oyer
and terminer for the said County at their last June term in the sum
of five pounds Current Money for having unlawfully and con-
temptuously neglected to convey to the Goal of the said County the
body of a certain Sal Sewell in Obedience to a Warrant for that
purpose signed by John Coulter Esqr. one of the Justices for the
aforesaid County, and further that he was fined by the said Court at
their January term last, in the sum of twenty pounds for having with
the assistance of Thomas Ring and Elias Smith of the same place,
Watchmen, unlawfully injuriously etc. assaulted and held in durance
a certain Thomas Dugan until the said Dugan obtained his liberty
by paying the said Bailey thirty five shillings. The Petitioner sets
forth that he was ignorant of the heinousness of these Offences at
the time he committed them and that he has served some years as a
Constable without incurring any censure on his Conduct until the
present occasion. He further alledges that he is so poor that the
payment of the said fines will utterly ruin him. The Board being well
certified that the Petitioner is entirely unable to pay the whole Sum
for which he is liable do in consideration of that Circumstance only,
Order that of the above fines amounting to twenty five pounds, the
sum of twelve pounds, ten shillings be and the same is hereby
remitted.
