CHAP.
 XXIV.

Orphans of
14 Years of
Age, to
choose Guardians;
if under,
Courts
to appoint;
to take into
their Hands
their Real Estates,
&c.

    II.  Be it Enacted, by the Right Honourable the Lord Proprietary, by and
with the Advice and Consent of his Lordship's Governor, and the Upper and Lower
Houses of Assembly, and the Authority of the same, That it shall and may be
lawful for the Justices of the several County Courts, and they are hereby authorized
and required on Application to them made, to permit such Orphans,
if above the Age of Fourteen Years, to choose his or her Guardian, and if
under the Age of Fourteen, then the said Justices to appoint a Guardian, and
immediately Order the said Orphan's Real Estate, into the Hands of such
Guardian, in the same Manner as they might or could have done, had the
Balance of said Estate been transmitted from the Commissary's Office:  And
such Guardian so as aforesaid Chosen or Appointed by this act, shall have
the same Powers, and be subject to the same Duties and Regulations, as
Guardians otherwise chosen or appointed are, by the Laws of this Province
now in Force, and when the Balance of the Person Estate is transmitted
(which is hereby declared to be his Duty to see done, as soon as the particular
Circumstances of the Deceased's Estate will admit) shall receive the same as
if then Chosen or Appointed; any Law, Usage, or Custom to the contrary
notwithstanding.

An Act to confirm the Sale of certain Land lying in Eastern-Neck Island, in
    Kent County, by Draper Lusby and Frances his Wife, Executrix of John
    Hynson, Deceased, to Matthew Bryan.  Lib. H.S.  fol. 517.  PR.
CHAP. XXVI.
Passed 26th
Nov. 1763.
An ACT to prohibit raising of Swine and Geese in Charles-Town, in Charles
    County.  Lib. H.S.  fol. 518.
    N.B.  By this Act,  (1.)  No Inhabitants of the said Town, shall keep or support, within the
said Town, any Swine or Geese, unless within their own Inclosures.  (2.)  Any such Inhabitants
suffering any Swine or Geese, belonging to themselves, or under their Care and belonging
to any other Persons, to go at large in the said Town, it shall be lawful for y Person to shoot
or destroy such Swine or Geese going at large.  (3.)  Persons sued for such shooting or destroying,
may Plead the General Issue, &c.
CHAP.  XXVII.
Ditto. An Act impowering the Justices of Prince-George's and Charles Counties, to
    levy on the taxable Persons of Saint John's (commonly called King George's)
    Parish, in the said Counties, the Sum of Fifty-six Thousand Pounds of Tobacco,
    for the necessary Enlargement of their Parish Church.  Lib.
H.S. fol. 519.
    N.B. 
By this Act, the Justices of the said Counties are impowered and required, on Application
of the Vestry-men and Church-wardens, to assess and levy on the taxable Inhabitants of
the said Parish, 56000 lb Tobacco, with the Salary of 5 per Cent to the Sheriff, at two equal
Assessments, to be respectively made by the said Justices, in Proportion to the taxable Inhabitants
of the said Parish, residing in their several Counties; to be paid and collected in the same
Manner as Public and County Levies; and to be paid by the respective Sheriffs, to the Vestry-men,
&c. of the said Parish, and by them be applied to enlarging the said Church, and to no
other Use, &c.

 
CHAP. XXVIII.
Ditto. An ACT for imposing an additional Duty of Two Pounds per Poll
    on all Negroes Imported into this Province.  Lib. H.S.  fol. 520.

Be it Enacted, by the Right Honourable the Lord Proprietary, by and with

and after the End of this Session of Assembly, all Masters of Ships and other
Vessels, and all other Persons importing or bringing Negroes into this Province,
either by Land or by Water, shall, at the Time of making their entry,
or bringing in the same, Pay unto the Naval-Officer of the Port or Place
where they shall make their Entry, or bring in such Negroes, the Sum of
Two Pounds Current Money, over and above what by the Laws of this Province
now in Force, is to be paid, for every Negro so imported or brought
in, on Penalty and Forfeiture of Ten Pounds Current Money for every Negro
so imported or brought in, and not paid for as aforesaid, to be recovered
