W.

WAGES.  See Ingrossers, 3.  Servants, 16.

WAR.

    1.  If his Lordship, or his Lieutenant-General make
War out of the Limits or Precincts of this Province,
without the Consent and Approbation of the General
Assembly, the Freemen shall not be obliged to assist
therein with their Persons or Estates.  1650, ch. 26,
§. 1.
    2.  Martial Law shall not be exercised within this
Province, but only in Camp or Garrison.  Ibid. 
§. 2.
    3.  But in case of Invasion, Insurrection, or Rebellion,
the Charges arising by Defence of the Province,
shall be defrayed by an equal Assessment upon the Persons
and Estates of the Inhabitants.  Ibid.  §. 3.

WAREHOUSES.

    1.  All Tobacco, to be Exported out of this Province,
shall be first brought to some or one of the Public

Warehouses, in this Act mentioned, and there
Viewed and Inspected.  1763, ch. 18, §. 2.  For the
List of Warehouses, see Inspectors, 2.
    2.  The Proprietors of the Warehouses, Wharfs, 
Prizes, &c. already built, and continued by this Act
for Inspection of Tobacco, are hereby obliged to Let
the same to the Inspectors, under Penalty of 32,000 lb

Tobacco:  And shall receive a Rent of 6 lb Tobacco
per Hogshead, to be paid to them by the several Inspectors;
(see below, Art. 4.)  And the Residue of the
56 lb Tobacco per Hogshead, and the 28 lb Tobacco
on the Eastern Shore, and the 24 lb Tobacco on the
Western Shore, per Hogshead, in this Act mentioned,
(§, 14 and 16,) shall be applied to defray Inspectors
Salaries, and other Expences attending the Execution
of this Law.  Accounts of all which, and the Profits
arising thereby, shall be annually laid before the Justices
by the Inspectors, on Oath:  Which Justices shall
settle the same, and apply the Profits, if any, to defray 
the County Charge.  Ibid.  §. 52.
    3.  No Proprietor of a Warehouse shall make private
Uses thereof whatsoever, while under Rent to the
Public, under Penalty of 1000 lb Tobacco.  Nor shall
Inspectors keep any Horses, Cattle or Hogs, upon any
Warehouse-Land, except in Inclosures.  And if any
Swine, belonging to an Inspector, shall be found at
large upon such Lands, or the Lands adjoining thereto,
the Proprietor of the Land on which such Warehouses
are placed, may kill or destroy them.  Ibid.
§. 53.
    4.  One Third only of the 6 lb Tobacco per Hogshead,
due for Rent on all Tobacco delivered out of the
Two Warehouses at Kingston, in Talbot County, shall

be paid to the Owner of the House on William Wilson's
Lot, and the remaining Two Thirds to the Owner of 
the House on William Gale's Lot.  Ibid.  §. 124.
    5.  The Justices of each County shall provide for
each Inspection-house, at the County Charge, a sufficient
Beam, Weights and Scales, to weight 1500
Gross at least, and a Set of small Weights, the same
as the Standard; and keep the same in good Repair,
together with the Blocks, Tackles, and other Necessaries.
And the Justices shall, sometime in March,
yearly, appoint Two or more of their Number to view
the Scales, and try the Weights by the Standard, and
to cause the necessary Repairs and Amendments to be
made; the Charge of which shall be paid by the Inspectors,
and be allowed to them in their Accounts.

    6.  Inspectors, immediately after the Conclusion of
their respective Inspections, and Prizing, yearly, shall

carefully take down the Scales, Ropes and Blocks,
belonging to their several Houses, and lay the same
carefully up, together with the Weights, in some Part

of the said Houses:  On Penalty (for Neglect) of
800 lb Tobacco; to be recovered before a Single
County Magistrate.  One Half to the Informer, the
other Half to the County Charge.  Ibid.  §. 130.
    7.   The Justices and Inspectors of each County,
shall annually meet at the Court-house on the Second
Tuesday of December (if fair Weather, if not,

on the next fair Day) under Penalty of 800 lb Tobacco
each.  At which Meeting it shall be determined
by a Majority of the Justices, upon the best Information
they can get from the Inspectors, &c. what
Buildings, Additions, Repairs, Wharfs, Cranes, or
other Conveniencies are wanting at each Warehouse.
And the said Justices shall appoint Two Justices most
convenient at each Warehouse, not being Proprietors,
to contract for such Buildings, &c. or other Conveniencies
so determined to be wanting.  Which Two
Justices shall, within Five Days, give Notice to the
Proprietors of such respective Warehouses to beet
them at some convenient Place by them in such Notice
to be appointed, at a Time not exceeding Ten
Days from the Date of such Notice; and shall then
and there inform such Proprietors, or his or their
Agent, what is required of them according to the
aforesaid Determination.  And if such Proprietors
will not immediately enter into Bond to his Lordship,
in a Penalty not exceeding 32,000 lb Tobacco, to do
what is required by the last of April next ensuing, at
farthest; or if, after such Bond given, such Proprietor
shall not compleat every Thing according to the Tenor
thereof; then shall such Justices forthwith agree with
some other Person for doing or compleating the same,
taking Bond for the Performance of such Agreement.
And, in case of the Death or Removal of one of the
Justices, the other shall have full Power to act herein.
Ibid.  §. 141.
    8.  The Bonds taken by such Justices shall be lodged
with the County Clerk, within Twenty Days after
taking thereof.  And any Justice neglecting his Duty
in making the Contracts, or taking or lodging the

Bonds, shall forfeit 800 lb Tobacco.  Ibid.  §. 142
and 143.
    9.  Whatsoever Sum such Justices may contract for,
as aforesaid, shall be assessed in the next County Levy.
after Performance; and be deducted out of the Tobacco

and Money arising due for the Rent of the 
House 'til the County be reimbursed.  Ibid.  §. 144.
    10.  County Courts have a full Power, at all other
Times of the Year, to put in Execution so much of

this Act as relates to Building, Repairing, &c. Public
Warehouses, and to regulate all Matters relating
thereto; and to direct the Building, &c. of any
Warehouses, Wharfs, Prizes, Cranes, and other
Conveniencies, as to them from Time to Time shall
seem necessary, &c.  And where the Proprietor,
Guardian, &c. or other Person concerned in any
Warehouse, shall refuse or neglect to make such
Buildings, Additions, &c. as shall be wanting at any
other Time of the Year, and such as the Justices shall
direct, then the said Justices have the same done
at the County Expence:  And the Justices shall receive
so much of the Rent from the Inspectors, as will
re-imburse such Charge to the County.  And if, on
Application of the Inspectors, such Justices shall refuse

to do their Duty herein, every Justice so neglecting
or refusing, shall forfeit 800 lb Tobacco, to be recovered
in the County Court, with Costs, by Action in
the Name of the respective Inspectors, and be applied
to the Use of such Warehouse, &c.  Ibid.  §. 145.
    11.  Every Justice who shall meet at their respective
Court-houses, or who shall be appointed and attend in
Order to agree as aforesaid, or to try and adjust the 
Weights, shall be allowed 64 lb Tobacco for every

Day's necessary Attendance, in consequence of such
Appointment, in the next County Levy:  And every
Inspector, who shall attend the Justices at the Court-house,
