Debate upon Security for the paymt: of one thousand one
hundred and fifty pounds of tobacco with Cort: Charges prffereth to with
drawes his accon Nicholas Rice in open Cort: ingageth to
pay the said one thousand one hundred and fifty pounds
of tobacco with Cort: Charges whereupon the accon was
withdrawne by Joynt Consent ~ ~ ~ ~

John Allen Ellis deft:
The plt: and deft: being Called appeare before the board
John Ellis Late of Sommersett County was Attached to
Answer Ambrose Dixon in A plea of Debt &c.
And whereupon the said Ambrose Dixon for himselfe saith that
he the said John Ellis Did upon the fifteenth day of oct in the XXXXth:
year of the Dominion of Caecilius Annoq Domini 1671 by
A Certaine speciallty signed with the hand and Sealed with y Seale
of him the said John Ellis which is produced by the plaintiffe
here in Cort: Assume upon himselfe and promise that he the
said Ellis woulld pay or Cause to be paid unto Ambrose
Dixon his heires executors: or assignes the full summe and
quantity
49 quantity of one Thousand fowre hundred sixty and seaven
pounds of good sound marchantable tobacco and Caske to be pd:
unto the aforesaid Ambrose Dixon on his aforesaid ordr: at the
dwelling house of the said John Ellis upon all Demands to the
performance of which the said John Ellis bindes himselfe
his heires executors: and admrs: But the said John Ellis little
Regarding his Assumption and promise but ffraudulently intending
to Deceive him the said Ambrose Dixon of the aforesaid quantity
of one Thousand fowre hundred Sixty and seaven pounds of tobacco
which being Demanded but he the said Ellis Denyeing and still
Doth to pay the same The plaintiffe saith he is Dampnified and
hath Dammadge and thereupon brings his Sute &c.
The ffollowing speciallty was read, vizt ; /
This bill bindeth me John Ellis of Morumsco Creek in Somersett
County in the province of Maryland plantor: my heires executors:
admrs: to pay unto Ambrose Dixon of the County and Province
aforesaid his heires executors: administrators: or assignes the full
summe and quantity of ffowerteene hundred sixty and seaven
pounds of good Sound marchantable tobacco and Caske to be paid
at my now Dwelling house upon all Demands wittnes my hand
and Seale the fifteenth day of octr: Annq: Domini one Thousand
Six hundred seaventy and one ; / ; ~ ~ ~ ~
