said Province whereby the said John is Damnified and hath
Dammadge to the vallue of Two Thousand nine hundred
pounds of tobacco and Caske and thereupon brings his Suite ; / ;
pro qued Henry Smith
John Dorman And the said Richard Stevens in his proper
agst: demurrer
Richard Stevens person Commeth and defendeth the force
and injury when &c And saith that he to the declaracon of the said
John above against him fyled ought not nor by the Law of the
Land is bound to answer, because he saith that the same declaracon
and the matter therein Conteined is not sufficient in Law to
Compell him to answer thereunto and the Richard for Cause of
demurrer according to the forme of the Statute Sheweth ; / ;
first that the Sd: decleracon saith that in y yeare 75 wch: is no yeare
secondly did tye up ahorsse of the sd: John untill the sd: horsse is
dead or Disabled from Service which makes no Certeinty of what
horse or whether the said horse were Dead at the time of the Sueing
out the original writt; Thirdly if the Deft: had taken the
horse of the said plt the sd: plt ought to have Replevyed him
& in an accon of Replevin to have Declared ; and thereupon the sd:
