Henry Smith plantr def Somerset County Ss Henry Smith planter Late of this County was sum
attatched to answr: unto James Barry Tanner in an accon of the Case &c
And whereupon the plte by Thomas Poole his attorney Comes & Saith that he the sd: Henry
in the year of or: Lord 1686 became indebted to the plte the full & Just Sume of Two
Thousand six hundred & twenty Eight pounds of tobacco as will in Cort: more plainely
appeare as pr accompt here in Cort: produced but he the Said Henry fraudulently intending
the plte to deceive of the aforesaid summe he the said Henry doth deny the deny to Serve
the plte Saith he is damnified and hath Damadge to the value of five thousand pounds
of tobacco & thereupon brings this Suite Jno: Doe

Somersett County Ss John Swaine of this County was summoned to answr: unto Ellis Coleman of a plea
that he render seaven hundred foote of planke well Sawne board wch to him he
oweth & unjustly deteineth
And wherupon the Said Ellis Coleman by Samll: Cooper his attorney Complaineth that
whereas the Said John Swaine upon the 26th: day of September in the year of or: Lord God
1681 Did by his bill or writing Signed with the hand & Sealed with the Seale of him
the said John & here in Cort: produced acknowledge himselfe to owe & Stand firmly indebted
unto the said Ellis or his Certaine attorney seaven hundred foote well Sawne board
Inch thick to be paid upon the Tenth day of September next ensueing the Date of the aforesd:
yet the Said John the said seaven hundred foote of board as aforesaid according to y
tenor of his bill aforesaid to the said Ellis hath not payd or Satisfied but the Same
to pay or Satisfie hitherto hath denied and Still doth deny to pay the Same to y
great Damadge of him the said Ellis whereupon the Said Elliss saith he is damnified
and hath Damadge to the vallue 1400 foote of Such planke board & thereupon he brings
his Suite Cooper pro quer Pledge de Po Jno: Doe
