DELEGATE PULLEN: I have no vote,
sir.
THE PRESIDENT: Is your switch not
working?
DELEGATE PULLEN: I voted No. I am
recorded as No.
THE PRESIDENT: We will so record
it, Delegate Pullen.
Any delegate desire to change his vote?
(There was no response.)
The Clerk will record the vote. There
being 13 votes in the affirmative and 124 in
the negative, the motion is lost. The reso-
lution is rejected.
I understand, Delegate Pullen, that your
vote was recorded on the sheet, the light
was simply not functioning; we will see
that it is corrected.
The next item of business is introduc-
tion and first reading of proposals.
Before I do that, I want to announce that
there has been returned to me at my re-
quest by the Chairman of the Committee
on the Executive Branch Delegate Pro-
posals Nos. 30 and 155. I have re-offered
these two proposals to the Committee on
State Finance and Taxation.
Let .me say in connection with that, the
reason for the action is this. Delegate Pro-
posal No. 23 also deals in general with
the subject of post-audit review. It is de-
batable whether post-audit review, if pro-
vided for in the constitution, would be a
function of the Executive Branch or of the
Legislative Branch.
1, therefore, referred it to the Committee
on State Finance to consider the entire
subject matter and make such recommenda-
tions as it chooses to the Convention. How-
ever, I have also requested the Chairman
of that Committee to act jointly with the
Chairman of the Committee on Executive
Branch and the Committee on the Legis-
lative Branch as a liaison committee so that
the members of all three committees will
be fully conversant with what is happen-
ing with respect to the proposals.
There are sixteen proposals today, No.
26I through to 276.
Delegate Proposal No. 261. The Clerk

A PROPOSAL that the Constitution
neither prohibit nor establish autonomy or
independence for the governing boards of
the University of Maryland, the state col-
leges, or any other institutions of higher
learning.
THE PRESIDENT: Delegate Proposal
No. 26I is referred to the Committee on
General Provisions.
Delegate Proposal No. 262. The Clerk
will read the proposal.

No. 262, by Delegate Carson. Title,
A PROPOSAL that the office of sheriff
shall be retamed as an elective office under
the Constitution.
THE PRESIDENT: Delegate Proposal
No. 262 is referred to the Committee on the
Judicial Branch. With respect to this pro-
posal, I wish also to announce that the
reference presents a problem because the
sheriff in every county performs functions
related directly to the Judicial Branch. In
some counties, he also performs other func-
tions, such as police, law enforcement func-
tions, keeper of the county jail. He also
performs the function in some counties of
being the court crier or bailiff, and has
custody of prisoners in the courtroom. I
have, therefore, referred the proposal to the
Committee on the Judicial Branch. How-
ever, I have requested the Chairman of the
Committee on the Executive Branch and
the Committee on Local Government to act
jointly with respect to this proposal so that
members of all three Committees will be
fully informed.
Delegate Proposal No. 263. The Clerk

state that the people of the State of Mary-
land establish this Constitution in order to
