DELEGATE J. CLARK: In accordance
with the explanation, I yield the floor to
Delegate Sherbow.
THE CHAIRMAN: The Chair recog-
nizes Delegate Sherbow.
DELEGATE SHERBOW: Mr. Chair-
man; thank you, Delegate Clark.
I wish to offer an amendment to page 1,
section 3.04, the effect of which will be to
strike out the words "one hundred five"
and insert "one hundred twenty." The
amendment is ready and will be passed out,
and I am personally asking the members
of the Committee to please add the name
after Sherbow, James, Sybert, the name of
E. J. Clarke, C-l-a-r-k-e.
I am prepared now, if it is in order, to
move the adoption of the amendment, but I
do not know whether it has been passed
around yet.
THE CHAIRMAN: The Clerk will read
the amendment. This will be Amendment
No. 8, to Committee Recommendation LB-I,
and as requested, please add to the spon-
soring delegates the name of Delegate
Clarke, C-l-a-r-k-e. The Clerk will read the
amendment.
READING CLERK: Amendment No. 8
to Committee Recommendation LB-I by
Delegates Sherbow, James, Sybert and
E. J. Clarke: On page 1 section 3.04 titled,
Composition of the Legislature, line 24,
strike out the words "one hundred five" and
insert in lieu thereof the words "one hun-
dred twenty".
THE CHAIRMAN: The Chair recog-
nizes Delegate Sherbow for the purpose of
moving the amendment.
DELEGATE SHERBOW: Mr. Chair-
man, I move the adoption of the amend-
ment. I would like to add only one word.
THE CHAIRMAN: We will give you
that opportunity as soon as the amend-
ment is seconded.
(Whereupon, the motion was duly sec-
onded,)
You may proceed.
DELEGATE SHERBOW: Members have
asked me why we do not have some refer-
ence to the number of senators. This is an
amendment to section 3.04, and it, there-
fore, will read as follows: "The number of
members of each house of the legislature
shall be as prescribed by law, but the num-
ber of delegates shall not exceed one hun-
dred twenty and the senators shall be one-
third the number of delegates."
That is the explanation I wish to make.
THE CHAIRMAN: The Chair recog-
nizes Delegate Bamberger.
DELEGATE BAMBERGER: Mr. Chair-
man, I desire to offer an amendment to
Amendment No. 8 to Committee Recom-
mendation LB-I. If it is available, I will
deliver it to the desk.
THE CHAIRMAN: I understand the
amendment is on its way, and I understand
further, Delegate Bamberger, that the ef-
fect of the amendment is to change one
number.
DELEGATE BAMBERGER: The effect
of the amendment is to change in Amend-
ment No. 8 the words "one hundred twen-
ty" to the words "one hundred eight". The
effect is, as Delegate Sherbow has pointed
out, to provide for a Senate of 36 members
and a House of Delegates of 108 members.
THE CHAIRMAN: The amendment is on
its way over and in order to save us time,
in the absence of objection, the Chair
would be disposed to permit debate to con-
tinue on these two amendments, the printed
amendment to be delivered to your desk
within the next five minutes or so. Is there
any objection?
Is Delegate Bamberger's amendment sec-
onded?
DELEGATE GALLAGHER: Yes, Mr.
Chairman, I so move.
The Committee of the Whole will please
come to order.
The question arises on the adoption of
Amendment 1 to Amendment 8, the effect
of which would be to change the words
"one hundred twenty" in line 4 of the
amendment to the words "one hundred
eight". The Chair recognizes Delegate
Bamberger to speak in favor of the amend-
ment.
DELEGATE BAMBERGER: Mr. Chair-
man, ladies and gentlemen of the Conven-
tion and of the Committe, because of the
procedure under which we operate in the
Committee of the Whole, this body would
not reach the point at which it could
deliberate upon and vote upon the Commit-
tee's recommendation of a Senate of 35
