and the fractional voting plan is not of-
fered, I personally will offer it to this body
in the interest of democratic action, so that
you will have it before you at some time
during these proceedings to debate one way
or the other.
I hope you will vote against the amend-
ment to the amendment.
THE CHAIRMAN: 1 assume that dopes
the debate. We are ready for the question.
DELEGATE GALLAGHER: Question.
THE CHAIRMAN: Will the doorkeeper
please see if there are any delegates im-
mediately outside the door and tell them
we are ready to vote?
The question arises on the adoption of
Amendment No. 1 to Amendment 8 to Com-
mittee Recommendation LB-I. This is the
amendment which would fix the size of the
House of Delegates at 108 and the Senate
at 36. A vote Aye is a vote in favor of
Amendment No. 1 to Amendment No. 8, in
favor of 36-108. A vote No is a vote against
the amendment and would be before
Amendment No. 8, which is the 40-120.
Therefore, a vote Aye, a vote in favor of
the amendment, 36-108; a vote No, a vote
against. Cast your votes.
Has every delegate voted? Does any dele-
gate desire to change his vote?
(There was no response.)
The Clerk will record the vote.
There being 57 votes in the affirmative
and 73 in the negative, the motion is lost.
The amendment is rejected.
The question now arises on the adoption
of Amendment No. 8 to Committee Recom-
mendation LB-I.

ment No. 8 to Committee Recommendation
LB-I; that is, a vote in favor of the 40-120.

leave the committee recommendation before

cluded a perhaps lengthy, but very orderly
debate on a most important question.

Section 3.04 is still before you for amend-
ment.

DELEGATE J. CLARK: Mr. Chairman,
are you recognizing me for—
THE CHAIRMAN: I recognize you for
the purpose of offering further amendment
to section 3.04, if you desire to do so.
DELEGATE J. CLARK: I do not desire
to do so, sir, but Judge Sherbow does and
has made a commitment to that effect.
THE CHAIRMAN: The Chair will rec-
ognize—
DELEGATE J. CLARK: If I can find
my notes, I will turn them over to him.
THE CHAIRMAN: Delegate Sherbow,
does the Chair understand that you pro-
pose to offer the amendment which bears
Delegate James Clarkes name as sponsor?
DELEGATE SHERBOW: Yes, sir. I
would like to make a very brief comment
as I offer it.
THE CHAIRMAN: Just a moment. The
amendment is being distributed to you. It
will be Amendment No. 9.
Please strike out the printed words, "to
Amendment No."
Strike out the name of the sponsor,
James Clark. Insert the name of the spon-
sor, Delegate Sherbow.

DELEGATE SHERBOW: I want to call
your attention to the fact that line 12 says
"105." It should read "120." Line 4 says
