and commanding officers of companies of their respective regi-
ments or a majority of them present at the meeting called for
the purpose ; the lieutenant-colonels shall be recommended by
the majors and commanding officers of companies of their re-
spective regiments or a majority of them present at the meeting
called for the purpose; the majors shall be recommended by the
commanding officers of companies of their respective regiments
or a majority of them present at the meeting called for the pur-
pose ; the company officers respectively shall be recommended
by the members of their company or a majority of them present
at the meeting called for the purpose ; and the brigade and
regimental staff officers shall be recommended by the respective
commanding officers of the brigade and regiments ; and when-
ever a brigadier-general is to be recommended the oldest com-
manding officer in rank in said brigade, shall give three days
notice of the time and place of holding the meeting therefor, in
at least three of the public newspapers in the city of Baltimore,
and whenever a colonel is to be recommended a similar notice
shall be given by the oldest officer in rank in his regiment, and
whenever a lieutenant-colonel, major or company officer is to be
recommended a similar notice shall be given by the command-
ing officer of his regiment. And any of such meetings may
adjourn from time to time, until the said recommendation shall
have been decided on, provided notice thereof is made public as
aforesaid; and the said meetings respectively shall appoint a
secretary who shall certify to the proceedings thereof and within
three days thereafter transmit them to the officer to whom by the
fifty-third section of the act, to which this is a supplement, re-
signations are directed to be made, who shall within five days
after such writ forward it to the governor and council and apply
for commissions for the officer or officers so recommended ;

 

Provided however, that in the first organization of the fifth
infantry regiment and regiment of cavalry as aforesaid, the
notice for the meetings to recommend the several officers in said
regiments be issued by the commanding officer of the first regi-
ment of riflemen, and the certified proceedings made to him,
who shall forward them and apply for commissions as aforesaid.
And if any officer shall neglect or refuse to comply with any of
the provisions of this section as required of him, he shall be
cashiered or fined a sum not exceeding one hundred dollars in
the discretion of such court martial as the case may require.

Proviso.

SEC. 8. And be it enacted. That the said brigade shall as-
semble for militia duty on the second Monday in April, second
Monday in May, second Monday in June, and second Monday
in October, agreeably to the provisions of the thirteenth section
of the original act, and the second section of the supplement
thereto passed at the last session.
