C Courts. adjourned till Second tuesday in 9 ber. 1691 - - - - - - - - - - - - - - - - - - - - - - Acoamack in Virginia ye 30th. of November: To all to whome these presents shall Come Lewes Knight of the County of Accamack in the Collony of Virginia Tayler, Sendeth greeting, know ye that I the said Lewes Knight reposing espetiall trust & Confidence in my right trusty and welbeloved friend mr.George Lane of the County of Somerset in the Province of Maryland Planter, have & by these presents, do by & with the advise & Consent of Ester my wife, make Constitute appoint nominate & Ordain the said George Lane my true lawfull rightfull authentique & certain Attorney within the premised County of Somerset in mine and our joynt names Stead and behalfe to make write or Cause to be made & drawn or written & to Subscribe or Assign Seal & deliver from under his hand and Seal, an ample large authentique compleat & Satisfactory Bill of Sale, transportation alienation enfoefment & Confirmation of all & Singular that Land & plantation or Messuage now or lately appertaining unto me the sd Lewes Knight my Heirs, Execcutors Admrs & Assignes by me purchased from Thomas:Davis of the Same County, Scituate lying & being upon the Back Creek of Mannanokin River in Somerset County abovesd & formerly Called Davis Choyce, and lately Since named the french Garden,Conteining by Estimation according to the Survey & Pattent thereof One hundred & ninety Acres or thereabouts be the Same more or less, togeather with all & Singular its houses buildings Structures,Edifices,Emoluments & appurtenances whatsoever upon the Same lying or being or thereunto apperteining in as large ample & express Terms as in law as usuall Custonery or rrequisit to render the Same authentique from me the sd Lewes Knight.my ---- Assigns Extors &Admrs.unto Miles Grey his Heirs Exters And Admrs & Assigns for ever with warranty unto him the sd Miles Grey his Heirs, Extors Admrs & Assigns for ever agt all & every person or persons Claiming or pretending to claime or have right title priveledge interest in or upon the premises by from or under me the sd Lewes my heirs,Extors Admrs of Assigns or by or with our or either of our Assent, promotion abettment or procurement & also hereby granting & giving to my sd Attorney moreover in Open Court to acknowledge & confess the promised Bill of Sale, & also to Doe & act all & every Other thing or things necessary requisit,legall usuall & legaly practiced to render the promised bill of Sale firme & Authentique, in wittness whereof I the said Lewes Knight & Ester my wife have hereunto Sett our hands & Seals this 30th day of November Anno Domini 1688 Lewes: Knight ? Signum Robert : Herley: Somerset County Ss. / Archibald Holmes was attached to answer unto ffrancis Jenckins of a plea of trespass upon y Case And whereupon the sd ffrancis Complaineth that whereas the sd Archibald the 17th. day lf April 1691:at Pocomoke within the Jurisdiction of this Court was indebted to the sd ffrancis the Sum of Six thousand two hundred twenty foure & a halfe pounds of tobacco as pr a perticular account thereof here in Court to be produced may appear, and the said Archibald to the sd ffrancis, in manner aforesd being indebted, did assume upon himself, & to the sd ffra: faithfully promise that he the said Archibald the sd Sum of 6224:& 2 pounds of tobacco the the sd ffrancis would & truely Content & pay. Nevertheless the said Archibald his promise & assumption aforesd not regarding but minding & fraudulently intending him the said ffrancis in this behalf to deceive & defraud the sd Sum of 6224lb & 2 of tobacco to the sd ffrancis as aforesd hath not paid but hath hitherto refused & doth still refuse to ye damage of the sd ffrancis of 12000lb: of tob. & thereof he brings this Suit &c.
