ROBERT BOWIE, ESQUIRE, GOVERNOR.
1. BE IT ENACTED, by the General Assembly
of Maryland, That
the Reverend Mr. Duncan (the present pastor of the said parish,)
Alexander Greer, John Barnes, John Mitchell and Doctor Samuel
Hanson, of Charles county, Alexander C. Magruder, of Annapolis,
and the Reverend Joseph G. J. Bend, George Grundy, Thomas
Hollingsworth, Edward Johnson, Richardson Stewart and
Robert Ferguson, of the city of Baltimore, or a majority of them,
be and they are hereby authorised to propose a scheme of a lottery
or lotteries to raise a sum of money not exceeding twenty thousand
dollars, to be appropriated for the repairing of the parish church
of Durham Parish, in Charles county, the building a chapel of
ease and the providing a parsonage in the said parish; and that
they, or any three of them, be and they are hereby authorised to
sell and dispose of tickets in the said lottery or lotteries in any
part of the state, exclusive of any control over the same by the
corporation of the city of Baltimore, any law or usage to the contrary
notwithstanding; provided the said Reverend Mr. Duncan,
Alexander Greer, John Barnes, John Mitchell and Doctor Samuel
Hanson, Alexander C. Magruder, Reverend Joseph G. J. Bend, George
Grundy, Thomas Hollingsworth, Edward Johnson, Richardson
Stewart and Robert Ferguson, or any three or more of them, before
they proceed to make sale of any ticket or tickets in the said
lottery or lotteries, shall give and execute a bond to the state of
Maryland in the penalty of seventy thousand dollars, conditioned
that they will well and truly conduct the drawing of the said lottery
or lotteries, and that they will apply the money arising therefrom
within two months after the drawing thereof, to the payment
of the prizes drawn therein to the adventurers to whom they shall
be due, and the necessary expenses incurred in the management
thereof, and deposit the residue thereof in the Bank of Baltimore,
subject to the order and the complete and entire control of the vestry
of Durham Parish. |

2. AND BE IT ENACTED, That the said bond shall
be lodged in
the clerk's office of Charles county, to be there recorded; and upon
such bond, or any office copy thereof, suit or suits may be instituted
against the obligors therein, or any of them, or their, or any
or their legal representatives, for any breach or noncompliance
with the condition of the same. |

WHEREAS it is represented to this general assembly
by the petition
of Edward Barton and William Kelley, through whose lands
the public road now runs, leading from Hunting creek mill to
Fowling creek mill, that one of the petitioners, namely, Edward
Barton, suffers great inconvenience in consequence of said road
running through his farm, which obliges him to keep three gates
on said road, they therefore think the turning said public road
round the said Edward Barton's farm would be of no disadvantage
to the public, therefore, |
