CHAPTER 2,
An Act to preserve the Side- Walks in the Village of
Union- Town, in Frederick County.
|
Not lawful to
ride, &c. any
horse over side
walks
|
Section 1. Be it enacted by the General Assembly of
Maryland, That from and after the first day of May next,
it shall not be lawful for any person or persons to ride,
drive, lead, hitch, or stand any horse, or drive any team,
carriage, or other vehicle, whatever, along and upon any
of the side- walks in said village or its limits.

Sec. 2. And be it enacted, That if any person or per-
sons after the said first day of May next, shall ride, drive,
lead, hitch, or stand any horse, or drive any team, car-
riage or other vehicle whatever, upon any of the side-
walks in said village, or its limits, such person or persons,
so offending, shall forfeit and pay for each and every of-
fence, the sum of one dolar, to be recovered, in the name
of the State of Maryland, before any justice of the peace,
as other small debts are recovered, one half of which to
be paid by the justice of the peace, who is to collect the
same, to the person who shall give information and sue
therefor, and the other half to be paid to the supervisor,
to be by him laid out and expended in the improvement
and repairs of the side-walks in said village.

Allowance to
justices

Sec. 3, And be it enacted, That justices of the peace
and constables enforcing this act, shall be entitled to the
same fees in every respect as in cases of the recovery of

small debts; Provided always, that upon judgment for
said fine and costs there shall be no supersedeas.

Hot to extend
to persons in
certain cases
|
Sec. 4. And be it enacted, That nothing in this act
contained shall be construed so as to extend to any person
or persons, their servants or assistants, passing across said
side-walks with their horses, teams, carriages, or other
vehicles, at the proper and necessary places, in going and
returning, in the pursuit of their necessary business.

Sec. 5. And be it enacted, That this act shall not be in
force until the first day of July one thousand eight hundred
and thirty-one, nor shall it then have effect unless a copy
thereof shall have been stuck up at two public houses in
