ter, and the Commission may in addition to the penalty hereinafter pro-
vided after the expiration of said time bury said animal or fecal-matter
and charge the cost thereof to the owner or the person upon whose prop-
erty the same is found.

1924, ch. 252, sec. 3,

1040. Any violation of the provisions of this Act are hereby declared
to be a misdemeanor and shall be punishable before any Justice of the
Peace or the Circuit Court of the County in which such offense is com-
mitted, and any persons adjudged guilty thereof shall be subject to a
fine not exceeding one hundred dollars ($100.00) or thirty days in the
county jail or both in the discretion of the Court.

1041. Whenever the State's Attorney or other person, lawfully repre-
senting the State in any civil or criminal proceeding in the Circuit Court
for said county, shall deem it necessary to have the testimony of any per-
son, residing in the District of Columbia, or elsewhere out of reach of the
process of said Court, and such person shall voluntarily attend any term
of said Court for the purpose of testifying for the State in such proceed-
ing it shall be lawful for the judge of said Court to allow said witnesses
so attending such sum as may be reasonble compensation for the loss which
they may sustain by such attendance, not exceeding ten dollars per diem ;
and certificates for the allowance so made shall be issued by the clerk of
said county and levied by the county commissioners as in the case of all
other allowances to witnesses.
