Section 52(4) and (11)
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, (Three-fifths of all the members elected to each of the two Houses
concurring), That it be proposed that the Constitution of Maryland read as follows:
Article IV - Judiciary Department
10.
(a) (1) The Clerks of the [several] Courts[, created, or continued by this
Constitution.] shall have charge and custody of [the] records and other papersf,] AND
shall perform all the duties which appertain to their [several] offices, as fthe same now
are. or may hereafter he] ARE regulated by Law. [And the]
(2) THE office and business of [said] THE Clerks, in all their
departments/ shall be subject to AND GOVERNED IN ACCORDANCE WITH
RULES ADOPTED BY THE COURT OF APPEALS PURSUANT TO SECTION 18
OF PHIS ARTICLE, [the visitorial power of the Judges of their respective Courts, who
shall exercise the same, from time to time, so as to insure the faithful performance of
the duties of said offieers: and it shall be the duty of the Judges of said Courts
respectively, to make, from time to time, such rules and regulations as may be necessary
and proper for the government of said Clerks, and for the performance of the duties of
their offices, which shall have the force of Law until repealed or modified by the
General Assembly.)
(b) The offices of the Clerks shall be funded through the State budget. All fees,
commissions, or other revenues established by Law for these offices shall be State
revenues, unless provided otherwise by the General Assembly.
26.
{The Clerks shall appoint, subject to the confirmation of the Judges of their
respective Courts, as many deputies under them, as the Judges deem necessary, to
perform, together with themselves, the duties of the office, who shall be removable by
the Judges for incompetency, or neglect of duty, and whose compensation shall be
determined by law. In Washington County, all deputy clerks and other employees of the
office of the clerk shall he appointed and be removable according to the merit system
procedure established by law for these deputies and employees. All deputy clerks and
of her employees of the office of the Clerk of the Circuit Court for Baltimore City,
excepting the Clerk, shall be selected and be removable according to a procedure
established by law for those deputies and employees.] DEPUTY CLERKS AND
OTHER EMPLOYEES OF THE OFFICE OF THE CLERK SHALL BE
APPOINTED AND REMOVED ACCORDING TO PROCEDURES SET BY LAW.

(4) Each Budget shall embrace an estimate of all appropriations in such form
and detail as the Governor shall determine or as may be prescribed by law, as follows:
