such other place or places as may be deemed most advan-

tageous to the interest of the company ; provided, however,

that nothing in this section or act contained, shall authorize

said company to use steam motive power on their said rail-

road, or any part thereof, or any larger motor, cars or car-

riages thereon, than such as are usual, and at the time being

permitted in the city of Baltimore, or street railroads in said

city ; and provided, further, that in constructing its said

railroad, the said company shall lay its said track or tracks

on the margin or margins of said streets, avenues, or county

roads, and. in such manner as not to interfere with the free

and convenient use of such streets, avenues or county roads,

and shall leave unoccupied and unobstructed by said track

or tracks and by the cars, motors or carriages using or run-

ning upon the same, a width of at least fourteen feet for

vehicles using said streets, avenues and county roads.

SEC. 6 A. Provided, however, that it shall be unlawful

provided, further, that in the construction of said road in

Baltimore County, and the proper repair of the same, and

of the keeping in repair of the same, and of the keeping in

repair of the road-bed within the limits of the tracks, the

same shall be done by said railroad company, under the

supervision and control of the County Commissioners of

Baltimore County.

SEC. 6 B. Provided, however, that it shall be unlawful

out the consent and approval of the mayor and city council

of Baltimore being first had and obtained ; and provided,

further, that in the construction of said road in Baltimore

City, and the proper repair'of the same, and of the keeping

roadbed within the limits of the tracks the same shall be

done by said railroad company under the supervision and

control of the Commissioners, of Streets of Baltimore City.

SEC. 7. And be it enacted, That the said company be and

they are hereby authorized in the constructing of said rail-

road over the streets, avenues and the county roads

roads to a width requisite for the purpose of the construc-

tion of said railroad, and whenever said company shall

determine to widen said roads, and when it becomes necessary
