AN ACT concerning

Child Sexual Abuse Victims - Examinations - Reimbursement

FOR the purpose of providing that a physician and certain hospital personnel other
professionals may receive payment from the Department of Health and Mental
Hygiene for certain services provided to a victim of alleged child sexual abuse;
specifying that a physician or hospital certain other professionals provide certain
counseling to victims of alleged child sexual abuse; defining certain terms; and
generally relating to payment by the Department of Health and Mental Hygiene to
a physician or hospital certain other professionals for certain services a physician
or hospital certain other professionals provides provide to a victim of alleged child
sexual abuse.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health - General

15-127.

(A) IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(1) "CHILD" MEANS ANY INDIVIDUAL UNDER THE AGE OF 18
YEARS.

(21 "INITIAL ASSESSMENT" INCLUDES:

(I) A PSYCHOLOGICAL EVALUATION;

(II) PARENTAL INTERVIEW; AND

(III) MEDICAL EVALUATION.

(2) (3) (I) FOR PURPOSES OF THIS SECTION, "SEXUAL
ABUSE" MEANS ANY ACT THAT INVOLVES SEXUAL MOLESTATION OR
EXPLOITATION OF A CHILD WHETHER OR NOT THE SEXUAL
MOLESTATION OR EXPLOITATION OF THE CHILD IS BY A PARENT OR
OTHER PERSON WHO HAS PERMANENT OR TEMPORARY CARE OR
CUSTODY OR RESPONSIBILITY FOR SUPERVISION OF A CHILD, OR BY
