BY repealing and reenacting, with amendments,
Article - Environment
Section 6-303

Annotated Code of Maryland
(1987 Replacement Volume and 1989 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Environment

6-303.

(a) [In this section, "Class I" means the low risk category or any successor
category for blood lead poisoning that is defined by the Centers for Disease Control.

(b)] A medical laboratory shall report TO THE DEPARTMENT the results of
[any] ALL blood lead or erythrocyte protoporphyrin [test that indicates a risk of lead
poisoning that is greater than Class I] TESTS performed on any child 18 years and
under [to the local health department of the jurisdiction where the child resides.

(c) A local health department shall report any information it receives under
subsection (b) of this section to the Department].

(B) A MEDICAL LABORATORY THE DEPARTMENT SHALL REPORT
THE RESULTS OF BLOOD LEAD OR ERYTHROCYTE PROTOPORPHYRIN
TEST TESTS INDICATING AN ELEVATED BLOOD LEAD LEVEL, AS
DEFINED BY REGULATION, TO:

(1) THE LOCAL HEALTH DEPARTMENT IN THE JURISDICTION
WHERE THE CHILD RESIDES; AND

(21 THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE.

(C) THE DEPARTMENT SHALL ADOPT REGULATIONS TO:

(1) GOVERN THE REPORTING REQUIREMENTS OF
LABORATORIES TO LOCAL HEALTH DEPARTMENTS THE DEPARTMENT
UNDER SUBSECTION (B) (A) OF THIS SECTION; AND

(2) PROVIDE FOR THE SHARING REPORTING OF
INFORMATION BY THE DEPARTMENT WITH TO LOCAL HEALTH
DEPARTMENTS AND THE DEPARTMENT OF HEALTH AND MENTAL
HYGIENE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1990.
