Article 89 - Division of Labor and Industry

69.

(a) The Amusement Ride Safety Advisory Board is created.

(b) (1) The Board consists of { 9} 44 members of whom { 1 member} 3
MEMBERS shall be { a representative} REPRESENTATIVES of the carnival owners,
2 shall represent the amusement park owners, 1 shall be a representative of the State or
county fairs, 1 shall be a mechanical engineer and 4 shall represent the public and 1 of
the public members shall be designated the chairman.

(2) The members of this Board shall be appointed by the Governor with
the advice and consent of the Senate for a term of [6] 4 years.

(3) THE TERM OF THE APPOINTED MEMBERS ARE STAGGERED
AS REQUIRED BY TERMS PROVIDED FOR MEMBERS OF THE BOARD ON
JULY 1, 1990.

[(3)] (4) All members serve until their successors are appointed and
qualified and the appointments are approved by the Senate.

(S) MORE THAN 2 MEMBERS MAY NOT RESIDE IN THE SAME
COUNTY.

(5) IN SELECTING THE MEMBERS OF THE BOARD, THE
GOVERNOR SHALL MAKE EVERY EFFORT TO ASSURE THAT EACH
REGION OF THE STATE IS REPRESENTED.

[(4)] (6) Vacancies shall be filled by the appointment for the unexpired
term by the Governor with the advice and consent of the Senate.

[(5)1 (7) The members of the Board shall receive the compensation
provided in the budget and shall be reimbursed for actual expenses.

[(6)] (8) The members of the Board are eligible for reappointment.

SECTION 2. AND BE IT FURTHER ENACTED, That the terms of office of
the Board members are as follows:

ft) At, upon the expiration of the term of office of each incumbent member as of
the effective date of this Act, the term of office of a Board member is 4 years; and

f2) The term of office of each of the 2 additional members is 5 and 6 years
respectively and thereafter 4 yours.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1990.
