CHAP. 123.

until he shall be sober, and also fine him if guilty of dis-
orderly conduct. Any justice of the peace resident of said
town, designated by the eaid commissioners upon complaint
made before him of the violation of any ordinance of the said
corporation, shall issue process in the name of the said com-
missioners to recover fines and penalties imposed for the vio-
lation of such ordinance against the party offending and may
determine the matter as in any case arising under the laws of
the State and shall receive the same fees therefor.
320. The style of all ordinances shall be, enacted or ordained

by the Commissioners of Upper Marlborough ; all cases for
the violations of any ordinances or by-laws shall be instituted
in the name of the Commissioners of Upper Marlborough
against offending parties, and all fines recovered in such cases
for the breach of any ordinance or by-laws of the corporation
before any justice of the peace for Prince George's county
authorized to act in such cases shall be collected by said justice
of the peace and paid over to the treasurer of the corporation
within one week after collection of the same. The justice of
the peace may in default of payment of any tines or penalty
imposed by him for the violation of any ordinances or by-laws
of the said corporation, commit the party fined to the county
jail for a period not exceeding thirty days, and the sheriff
shall receive and confine the party so committed in the same
manner as other persons, and shall be entitled to the same
compensation therefor.

Provision
made in case
of Vacancy,
etc.

322. In the event of a vacancy in the office of justice of
the peace resident in the town, or in case of sickness, absence,
or disability of said justice, the hearing of the case or trans-
action of the business assigned to said justice by this charter
may be had before any other justice of the peace in and for
Prince George's county, and the Town Commissioners of
Upper Marlburough may provide for the expense so incurred.

Road tax
levied.

323. The County Commissioners of Prince George's county
shall appropriate annually the full amount of road tax levied
or imposed upon the assessable property within the corporate
limits of said town, and shall order the County Collector to
pay said road tax when so collected to the Town Commis-
sioners of Upper Marlborough.

over to

missioners.

324. The clerk of the Circuit Court for Prince George's
county shall pay over to the Town Commissioners of Upper
Marlborough one-half of the money received from liquor
licenses under section 252 of Article 17 of the Code of Public
Local Laws for places of business within the corporate limits
