March Court 1760 8 For ye said Sarah Records Against ye afd. Joshua Hoffington that he ye said Joshua Should be thereon Convict that then he the said Joshua should pay and Satisfie unto ye. afd. Sarah ye Judgment of ye Court thereupon or render his Body in Execution of such Judgment to ye Prison of ye Sherriffe of ye County afd. in Satisfaction thereof or that he the said John Killum will do ye Same for him &c Whereupon ye said Joshua Hoffington puts in his place Samuel Wilson Gent. Atty at Law agt ye afd. Sarah Records in the afd. Plea And thereupon at ye Prayer of ye Parties afd. day is to them here now given untill next Court to be held at Princes Ann Town ye third Tuesday of June then next following in ye State that now Saving to ye Parties afd. Att which day here Came ye Parties afd. by their Attys afd. And hereupon ye said Sarah Complained agt ye afd. Joshua in ye plea afd. in form following Somerset fst Joshua Hoffington Late of Somerset County Planter was attached to answer unto Sarah Records of a plea of trespass upon ye Case and so forth And Whereupon ye said Sarah by William Hayward her attorney complains that Whereas ye said Joshua on the day of in ye year of our Lord one thousand seven hundred fifty and at Somerset County afd. in Consider: unmarried :ation that the afd. Sarah then & Still & Single and ^ ye special Instance and request of ye afd. Joshua then & there had agreed with ye same Joshua and had taken upon herself and faithfully Promised ye same Joshua that She ye afd. Sarah would Marry him ye afd. Joshua took upon him self and then & there faithfully Promised that he ye afd. Joshua would marry her ye Giving afd. Sarah and Altho ye said Sarah ^ Credit to ye Promise & Assumption of ye afd. Joshua Altogether refussed to Contract Matrimony with Any other man and yet Continueth a Single and unmarried woman and always from ye time of Making ye Promise & Assumption afd. was ready and often offered Legally to Marry ye same Joshua to wit at Somerset County afd. Nevertheless ye said Joshua not regarding his promise and Assumption afd. but Contriving And fraudulently Intending to Deceive and Defraud ye said Sarah in this Behalf hat not Married her ye said Sarah (Altho so to do ye afd. Joshua often his promise And Assumption afd. made to wit on ye Day of And often since at ye County afd. by ye said Sarah was required) but altogether her to Marry hitherto hath refussed and still doth refusse whereupon ye said Sarah says she is worse and hath Damage to ye Value of one hundred pounds Current money of Maryland & thereof he brings Suit & so forth Pledges &c J. Doe & R. Roe And ye afd. Joshua Hoffington by Samuell Wilson his Attry Comes & Defends ye force & Injury when &c And pryas Leave thereof to Imparll here untill next Court to be held at Prince Ann Town ye third Tuesday of August then next follg. & he hath it & ye same day is given to ye afd. Sarah here also &c. Att which day here Came as well ye afd. Sarah as ye afd. Joshua by their Attys Aforesaid |
