VOTES AND PROCEEDINGS, NOVEMBER SESSION, 1808. 13

A petition from Benjamin Buckler, of Saint-Mary's county, praying to be supported out of the poors house,
was preferred, read, and referred to Mr. Hopewell, Mr. Neale and Mr. Blakistone, to consider and report
thereon.

Mr. Partridge and Mr. Covington, from the senate, acquaint the Speaker that the governor elect is attending
in the senate room, and the senate requests his attendance, with the members of the house of delegates, in the
senate room, to see the governor qualified.

The Speaker left the chair, and, attended by the members of this house, went to the senate room, where his
excellency qualified in the presence of both houses, by subscribing a declaration of his belief in the Christian
religion, by taking the several oaths required by the constitution and form of government, the oath of office
directed by act of assembly, and by taking the oath to support the constitution of the United States.

The Speaker, attended by the members of this house, returned and resumed the chair.

The house adjourns until to-morrow morning 9 o'clock.

TUESDAY, November 15, 1808S.

THE house met. Present the same members as on yesterday. The proceedings of yesterday were read,

A petition from sundry inhabitants of Harford county, praying commissioners maybe appointed to lay out
and make alterations in the old road from William Ashmore's mill to Slate ridge, was preferred, read, and re-
ferred to Mr. Streett, Mr. Sanders and Mr. Forwood, to consider and report thereon.

Mr. Kerr and Mr. Stevens have leave of absence.

A petition from sundry bailiffs and constables in Queen-Anne's county, praying a compensation for serving
state process, was preferred, read, and referred to Mr. Scott, Mr. Hopper and Mr. Wright, to consider and
report thereon.

On motion. Leave given to bring in a bill, entitled, A further supplement to the act, entitled, An act for
keeping up the roads tu the several counties therein mentioned. ORDERED, That Mr. Frazier, Mr. Sanders and
Mr. Cottman, be a committee to prepare and bring in the same.

The following message was read.

By the HOUSE of DELEGATES, November 15, 180S.
Gentlemen of the Senate,

WE propose on —— next, if agreeable to your house, to go into a joint ballot for the election of a senator
to represent this state in the senate of the United States after the third day of March next; and to regulate

said election, we have adopted the Following resolution:

RESOLVED, That such senator to be chosen shall be a resident of the western shore of the state of Maryland,
and that the person having the majority of ballots of the attending members of both houses of the legislature
be declared to be duly elected to represent this state in the senate of the United States;. and that a commission
issue to the said senator appointed as aforesaid, signed by the governor for the time being, or in his absence by
the presiding member of the council, in the following words, to wit: " The State of Maryland to ———,
Greeting. The Legislature of Maryland reposing especial confidence in your integrity and abilities, have ap-
pointed you senator to represent this state in the senate of the United States from the third day of March next
until the —— day of March, eighteen hundred and ——. Given under my hand, and the seal of this state,
this —— day of ——, in the year of our Lord one thousand eight hundred and ——, and in the year of
the Independence of the United States of America. "

A petition from William Smith, of Harford county, praying that a law may pass making a devise of certain
lands to him by his father's will a devise in fee, was preferred, read, and referred to Mr. Forwood, Mr. Streett
and Mr. Sanders, to consider and report thereon.

ORDERED, That this house, to-morrow at twelve o'clock, proceed to the appointment of a director to the
Bank of Baltimore, on behalf of this state, for the ensuing year.

Mr. Dorsey, from the committee, delivers to the speaker a bill, entitled, An act to repeal all such parts of
the act, entitled, An act to regulate and discipline the militia of this state, as require each noncommissioned
officer and private, liable to militia duty, to arm himself with a good and serviceable firelock, and for other
purposes; which was read the first time and ordered to lie on the table.

Mr. Moffitt, from the committee, delivers to the speaker the following report:

THE committee to whom was referred the petition of John Lynch, of Kent county, beg leave to report, that
they have had the same under consideration, and are of opinion that the facts therein stated are true, and that
the sum heretofore allowed him under his late misfortune, has become inadequate for his support; and under
the impression that it becomes the duty of the state to provide for the unfortunate and war-worn soldier, who
spent the prime of his life, and shed his blood, in fighting the battles of his country, beg leave to recommend
the following resolution:

RESOLVED, That the treasurer of the western shore be and he is hereby directed and required to pay John
Lynch, of Kent county, late a soldier in the revolutionary war, or to his order, the sum of thirty-three pounds,
