At a SESSION of the GENERAL ASSEMBLY of
MARYLAND, begun and held at the CITY of
ANNAPOLIS, on Monday, the 1st of November,
in the year of our Lord 1802, and ended the nth
of January, 1803, the following laws were enaded.

JOHN FRANCIS MERCER, ESQUIRE GOVERNOR.
CHAP. I.


An ACT relative to the continuance of causes in the court of appeals,
and to alter the time of holding the same

Passed 8th of
January, 1803,

BE IT ENACTED, by the General Assembly of Maryland, That the court of appeals, now sitting, be
and they are hereby authorised to continue any cause depending in the said court until and
during the November term, eighteen hundred and two, which they may in their discretion think
proper, in order for a hearing on the merits, and not for delay.

tinue causes.

II. AND BE IT ENACTED, That no acton pending, or which may hereafter be instituted, in the
court of appeals, shall continue longer than the end of the fourth court after the same shall have
been instituted, unless by consent of parties, at the discretion of the court.

No action to

III. AND BE IT ENACTED, That the court of appeals shall be held on the second Tuesday in the
month of June, and the second Monday in the month of November next, and the said court shall for
ever thereafter be held on the second Tuesday in the month of June, and the second Monday in the
month of November, in each and every year, any law to the contrary thereof in any wise notwith-
standing.

CHAP. II.

When court is
to be held.

An ACT to settle and ascertain the salary of members of the council
for the ensuing year.

Passed 8th of
January, 1803.

BE IT ENACTED, by the General Assembly of Maryland, That each member of the council shall be
entitled to receive, for the ensuing year, the sum of two hundred pounds current money for
his salary.

CHAP. III.

Salary ascer-
tained.

An ACT for the relief of John Erskine, of Talbot county.

WHEREAS John Erskine, of Talbot county, hath set forth by his petition to this general as-
sembly, that he was included in an act passed at November session, eighteen hundred and
one, entitled, An act for the relief of sundry insolvent debtors: And whereas from indisposition,
and other circumstances, he the said John Erskine was unable, after making application and deliver-
ing a schedule of his property to the chancellor, to comply with the terms of the said law by the
time in the said act limitted; And whereas it appears to this general assembly, that it will operate
greatly to the injury of both the said John Erskine and his creditors if he is deprived of the benefit
of the said act; therefore,

Passed 8th of
January, 1803,
Preamble.

II. BE IT ENACTED, by the General Assembly of Maryland, That the said John Erskine, by comply-
ing with the provisions of the aforesaid act within two months after the passage of this act, shall be
entitled to all the benefits of the said act, in the same mariner as if he had complied with the terms
of the said ad by the time in the said act mentioned, any thing in. the said act mentioned to the con-
trary notwithstanding,
