II. BE IT ENACTED, by the General Assembly of Maryland^ That the said Margaret Raser be and she
is hereby authorised and empowered to dispose of her said one fourth part of said land, and to con-
vey all her right, title and interest to the same, in -as full and ample a manner, and as effectually in
law, as if she were a feme-sole any law, usage or custom, to the contrary in any wise notwithstand-
ing,

CHAP. IX.

An ACT to lay out a road from M'Calister's plantation to Elisha and
David Gorsuch's mill, and from thence to John Ruteledge's plan-
tation.

Preamble.

WHEREAS it is represented to this general assembly, by the petition of Elisha and David Gor-
such, and several other inhabitants of the upper part of Baltimore county, that many advan-
tages would arise by opening a public road from M'Calister's plantation, on the York road, to the
mill of the said Elisha and David Gorsuch, and from thence to the plantation of John Ruteledge,
laying on the said York road; and the prayer of said petition appearing reasonable, therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That William Couleson, William John-
son, of William, and James Lytle, or amy two of them, be and they are hereby appointed commis-
sioners to survey, mark and lay out, at the exp-ence of the said Elisha and David Gorsuch, a road,
not exceeding thirty feet wide, on the streightest and best direction that the nature of the ground
will admit, from the York road, at M'Calister's plantation, to the said Elisha and David Gorsuch's
mill, and from thence to the said York road at John Ruteledge's plantation; and the said road when
so surveyed, marked, laid out and opened, and the valuation herein after diredled to be made and
paid shall have taken place, a plot thereof shall be returned to the clerk of the county, who shall
record the same among the records of Baltimore county court, which shall be deemed and taken to
be a public road for ever thereafter, and shall be kept up, and amended and impaired, as all other
public roads. in the said county.

III. AND BE IT ENACTED, That should a difference of opinion arise between the pid Elisha and
David Gorsuch and any person or persons through whose lands the said road may pass, concerning
the damages that may be sustained thereby, it shall and may be lawful for the person or persons so
aggrieved to apply to a justice of the peace for said county, and on his, her or their complaint, to
issue his warrant to the sheriff of said county, commanding him to summon a jury of twelve lawful
men of his county, connected to neither party, nor having any lands through which the said road
may pass, to appear, on a day to be mentioned in said warrant, on the lands of the person. or per-
sons so applying, before him, or some other justice of the peace for said county, the jury having
first made oath, before the justice of the peace so attending, that they will, without favour, affecli-
on, prejudice or partiality, assess the damages sustained by reason of opening the aforesaid road
through the lands of the person or persons applying as aforesaid, shall thereupon proceed to assess
and value the damages accordingly.

IV. AND BE IT ENACTED, That the said commissioners shall not lay out or open the said road
through the buildings, gardens, meadows or orchards, of any person or persons, without his or

their consent.

CHAP. X.

An ACT to extend the powers of the trustees of the poor of Mont-
gomery county.

Preamble.

WHEREAS James Haney, by his petition to this general assembly, hath set forth, that he is a
very poor man, and is now arrived to the age of eighty-six years, and that by reason of his
advanced age and bodily infirmities he is unable to support himself by labour, and prays that an act
may pass for his support out of the poor-house; and the prayer of the petitioner appearing reasona-
ble, therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That it shall and may be lawful for the
trustees of the poor of the said county of Montgomery, if they shall be of opinion that the peculiar
