placed on the general ballot except those selected in the
manner hereinafter prescribed. The primary elections for
such nomination shall be held on the fourth Tuesday in
January in the year of 1941 and every four years there-
after. The judges appointed for the general municipal
elections shall be the judges of the primary election and
the polls shall be opened at 8 A. M. and close at 8 P. M.
and with the same clerks as are required for the general
municipal election. Any person desiring to become a can-
didate for Mayor or City Councilman shall, at least 12
days prior to said primary election, file with the City Clerk
a statement of such candidacy in substantially the follow-
ing form: Candidate for Nomination for Mayor/Council-
man of the........................................................................

State of Maryland, Washington County:

I.................................................................., being first duly sworn,

say that I reside in Ward No................... at...............................................

Street, City of Hagerstown, County of Washington, State
of Maryland; that I am a qualified voter therein; that I am
qualified to hold office; that I am a candidate for nomina-
tion to the office of Mayor/Councilman for Ward No...................

to be voted upon at the Primary Election to be held on
the.................. day of.................................... 19............. and I hereby

request that my name be printed upon the official primary
ballot for nomination by such primary election for such
office. And I do hereby further certify that my regis-
tered party affiliation is.........................................................................

Said certificates shall be accompanied by a filing fee of
$50. 00 for all candidates for nomination for the office of
Mayor and a filing fee of $25. 00 for all candidates for
nomination for the office of Councilman, provided how-
ever that any candidate may withdraw his candidacy and
secure the return of said filing fee by a written notice of
such withdrawal filed with the City Clerk more than
12 days from the date of said primary election, and in the
event that no such withdrawal is made and that there is
no opposition to such candidacies, as above set forth, the
said filing fees shall be retained to be used to defray the
expenses of election.

285A. The Board of Election Supervisors for the City
of Hagerstown shall cause to be prepared at least 5 days
prior to said primary election ballots for each Ward in one
