CHAP. CXXI.

Passed 20th of
January, 1808.

A Supplement to the act, entitled, An act for the benefit of Marga-
retta Chalmers.

Preamble.

WHEREAS by the act to which this is a supplement, the right and interest of the state of
Maryland in that part of the estate of James Chalmers therein described, was released to
the said Margaretta Chalmers, and doubts being entertained whether the debts and claims of the
creditors of the said James Chalmers are riot thereby impaired: And whereas John Hayne, adminis-
trator of Gideon Hayne, hath by his petition set forth, that a part of the said property was mortgaged
to the said Gideon Hayne in his life-time by the said James Chalmers, and that the claim of the re-
presentatives of the said Gideon Hayne is by the said act of assembly altered and impaired; therefore,

Not to alter
rights, &c.

II. BE IT ENACTED, by the General Assembly of Maryland, That nothing in the said act of assembly
contained shall in anywise alter or impair the rights and claim of the representatives of the said
Gideon Hayne, or of any other person or persons whatsoever, in or tu the said property in the said
act of assembly mentioned.

CHAP. CXXII.

Passed 20th of
January, 1808.

An ACT to enable Margaret Hammond and Harriet Hammond, to
erect a bridge across Patapsco river, at a place called Hammond's
Ferry.

Preamble.

WHEREAS it is represented to this general assembly, by Margaret Hammond and Harriet
Hammond, that they are possessed of a ferry on Patapsco river, which hath been used and
enjoyed for many years past by their predecessors, and that a proper encouragement was given, a
bridge might be erected over the said river, which would greatly facilitate the intercourse to and
from the city of Baltimore to many parts of the state: And whereas the said Margaret and Harriet
Hammond have proposed to erect the said bridge, of a sufficient width for carriages to pass and re-
pass at all times and seasons of the year, at their own expense, provided a law was passed enabling
them to demand a certain toll from all persons passing and repassing the same; therefore,

A bridge may
be built, &c.

II. BE IT ENACTED, by the General Assembly of Maryland, That the said Margaret and Harriet
Hammond shall have full power and authority to build and erect, at the place commonly called Ham-
mond's Ferry, on Patapsco river, a bridge across the river Patapsco, which said bridge, when erected,
shall be of sufficient width for all carriages to pass and repass over the same; and it shall and may
be lawful for the said Margaret Hammond and Harriet Hammond, and all and every person and per-
sons claiming under them to ask, demand and receive, for the term of twenty-eight years hereafter,
as a toll or compensation for safe transportation over the said bridge, according to the following
rates, to wit: For a single person, three cents; a horse and rider, twelve and a halt cents; a four
wheeled carriage of pleasure or burthen, if loaded, with four horses, oxen or mules, and the driver,
and for each horse, oxen or mule, above the said number, eight cents, seventy-five cents; if light,
fifty cents; a four wheeled carriage of pleasure or burthen, with two horses, oxen or mules, and the
driver, if loaded, sixty-two and a half cents, if light, forty cents; a carriage with two wheels and
one horse, twenty cents; a cart with two wheels, with two or more horses, oxen or mules, and the.
driver, if loaded, thirty-seven and a half cents, if light, thirty cents; horned cattle, each four cents;
horses, oxen, mules and asses, cash six cents; sheep and hogs, each two cents.

And a cause-
way made, &c.

III. AND DE IT ENACTED, That the said Margaret and Harriet Hammond, and their assigns,
shall have fall power and authority to make a causeway, by filling up the shoals and fiats on the south
side of said river to lite channel thereof, provided that the said channel be kept open one hundred
and thirty feet wide at least; and provided always, that it is the true intent and meaning of this act,
that the said Margaret and Harriet Hammond, and all persons claiming under them, shall not be
permitted, in virtue of any power vested in them by this act, to obstruct, or in any manner impede,
the passing and repassing, and repassing, of any vessels of any size, description or name, up and down
the said river Patapsco, but the said Margaret and Harriet Hammond, and all those claiming under
them, shall be obliged to have a free passage: kept open, either by a drawbridge or otherwise, for all
vessels of every size or description to puss and repass through the said bridge; and provided also, that
the said Margaret and Harriet Hammond, or their assigns, shall enter into bond to the state of Mary-
land, with security to be approved of by Baltimore county court, and to be recorded in the county
court of said county, to finish the said bridge within the term of three years, and keep the same in
repair during the term of twenty-eight years, and to comply with terms and conditions enjoined on
them by this act.
