AN ACT to repeal and re-enact, with amendments, sub-
section (b) of Section 540 of the Charter and Public
Local Laws of Baltimore City (1949 Edition), title
"Miscellaneous Laws, " sub-title "Police Commissioner, "
heading "Appointments and Promotions, " so as to pro-
vide that promotions shall be made from a graded list
consisting of the number of top names on the eligible
list equal to e» TWENTY plus the number of vacancies
to be filled.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That sub-section (b) of Section 540 of the Charter and
Public Local Laws of Baltimore City (1949 Edition), title
"Miscellaneous Laws, " sub-title "Police Commissioner, "
heading "Appointments and Promotions, " be and it is
hereby repealed and re-enacted, with amendments, to read
as follows:
540.
(b) The Police Commissioner shall make all appoint-
ments and promotions in the Police Force, except Inspec-
tors of Police, Police Surgeons, and the Secretary of the
Police Commissioner and his assistants, from such graded
lists. Candidates shall be considered and shall be promoted
or appointed, in the discretion of the Commissioner. [, pro-
vided, however, that the Commissioner must appoint or
promote] New appointments shall be made by the Com-
missioner from the first ten (10) TWENTY (20) names
on any list. When such appointed list of ton (10) TWENTY
(20) names is exhausted through appointment [or promo-
tion] by the Police Commissioner a new [nominated] list
of ten (10) TWENTY (20) names shall be supplied by the
Personnel Officer. In the case of promotions, the Personnel
Officer shall furnish to the Commissioner a list which shall
contain a name for each vacancy to be filled plus ten
TWENTY (20) additional names. Promotions shall be
made by the Commissioner, in his discretion, from such
list. Applicants may be removed from the nominated list
by the Personnel Officer at any time for cause as set out in
Section 541 of this Article.
