Anne Arundel County law against auto or motorcycle races
on Sunday. The extremely heavy traffic on the Ritchie
Highway on Sundays would be even worse if the auto race
track on that highway were permitted to operate on Sun-
days. I am informed that County police officials believe it
would unduly and unnecessarily add to the burden of law
enforcement at a peak period.

HOUSE BILL NO. 857

Dear Mr. Speaker:


I have this day vetoed House Bill No. 857. This Bill
would license retail gasoline dealers in Allegany County.
The major provisions of the Bill are the requirement of at
least one and not more than two signs on every gasoline
pump, giving the exact itemized cost per gallon of the motor
fuel. Posting or display of any other signs about the prem-
ises which are "designed or calculated to cause the public
to believe that they state or relate to the price of motor fuel"
is prohibited. Sellers of gasoline which has no brand name
or trade mark must display on the dispensing equipment the
words, "No Brand".

The provisions prohibiting signs would seem to be an un-
warranted invasion of private rights bearing no reasonable
relation to the public health, safety and welfare. Similarly,
the failure to use a brand name or trade mark on a product
so long as there is no attempt at deception, or misrepre-
sentation that it is actually a branded product, would seem
to involve no public interest. Adequate remedies exist if
such fraudulent representations are made. If there are
problems of the filling station business requiring regulation,
they should be imposed at the State level in the same manner
that the products are taxed.
