C H A P.
XCV

herself or themselves aggrieved by such valuation and assessment of damages, made or to be made
by the commissioners respectively, it shall and may be lawful for any justice of the peace, on his,
her or their application, to issue his warrant, under his hand and seal, directed to the sheriff of the
county, commanding him to summon five disinterested men, qualified by law to serve as jurors in
the county court, to meet on the premises on a certain day, of which six days notice at least shall
be given to the party or parties interested, and the said jurors, when so met, and having each first
taken an oath before some justice of the peace, that he will, without favour, affection, prejudice or
partiality assess the damages sustained by the person or persons it whose request such inquisition
shall be taken, by reason of opening the aforesaid road through his, her or their land, shall there-
upon proceed to assess and value the damages accordingly, taking into consideration the advantages
and disadvantages, if any, and such inquisition and valuation shall be final and conclusive between
the parties respectively; provided, that in case the damages or valuation allowed by said inquisition
shall not exceed the allowance which shall have been made by the commissioners, the party applying
for said jury shall pay all cost incurred by reason of such application.

CHAP. XCVI.

An ACT to prevent swine from going at large in North. Sassafras,
West Sassafras and Bohemia Hundreds, in Caecil county.

Swine not to
go at large, &c.

BE IT ENACTED, by the General Assembly of Maryland, That from and after the first day of June
next, no swine shall be suffered to go and remain at large within North Sassafras, West Sassa-
fras and Bohemia Hundreds, in Caecil county; and if, after the day above mentioned, any swine
shall be found going and remaining at large within the aforesaid hundreds in said county, it shall
and may be lawful for any person or persons to impound the same, and if impounded, such person or
persons shall immediately give notice, by advertisements set up at the most public places in the hun-
dred where the said swine were found, describing the swine so impounded, and if the owner or
owners shall not, within ten clays after the setting up said advertisements, prove his or her property
therein, and make compensation for the injury, if any, which may have been sustained by any inha-
bitant of either of the aforesaid hundreds, to be ascertained by any two disinterested persons, inha-
bitants of the hundred wherein the said swine are impounded, and shall not pay, for every such
swine the sum of twenty-five cents for every day it shall have been so impounded, it shall and may
be lawful for the person or persons so impounding as aforesaid to sell, or kill the same, and the per
son or persons so selling or killing the said swine, shall deduct the costs and damages out of the sale
or value thereof, to be ascertained by two disinterested persons of the hundred where such swine
were impounded, and the overplus, after said deduction, the person or persons so selling or killing
the said swine shall pay to the owner or owners thereof.

General issue
pleadable, &c.

II. AND BE IT ENACTED, That if any person or persons shall be sued or impleaded for selling or
killing any such swine as aforesaid, the defendant or defendants may plead the general issue, and
give this act and the special matter in evidence; provided, that nothing in this act contained shall
be construed to extend to any part of Caecil county further than is herein above mentioned.

Preamble.

An ACT for the payment of the journal of accounts.

WHEREAS it appears by the journal of accounts of this session, that there is due from this
state the sum of twenty seven thousand nine hundred and seventy-three dollars and twenty-
two cents,

II. B n IT ENACTED, by the General Assembly of Maryland, That the treasurer of the western shore
shall and he is hereby authorised and required to pay the several persons, their executors, admini-
strators, assigns or order, or to such of them as shall offer to receive the same, the several sums of
current money allowed to them respectively, as they appear to be settled and ascertained by the said
journal of accounts, out of any money now in the treasury, or that shall come into the treasury,
subject to the appropriation of the general assembly.

A Supplement to an act, entitled. An act for the relief of sundry
insolvent debtors.

WHEREAS doubts have arisen on the construction of several of the provisions of the act of
the general assembly of Maryland, passed at November session, one thousand eight hundred
