COMMISSIONS ALLOWED TO EXECUTORS,&c.

Every executor, &c., upon the passage

   

of his, &c., accounts, on which commission

   

shall be allowed, to pay to register of

   

wrills the proportion of commission allow-

   

ed, as required by 1st section, and on fail-

   

ure to do so within 30 days from passing

   

said account, register to five notice to de-

   

puty attorney general, who shall put the

   

bond of such executor, &c. in suit for the

   

use of the State.

"

The said registers on or before the 1st

   

days of October and January, to pay to

   

treasurer all sums received by them, ac-

   

companied with statement of amount re-

   

ceived under oath, and on failure, bond to

   

be put in suit and recovery had for the

   

amount they may fail to pay, with interest

   

nt the rate of 10 per cent, from time of

   

default.

"

Upon payment to registers, they to give

   

to executor duplicate receipts, one to be

   

forwarded by exccuior to the treasurer,

   

copies to be evidence in suits upon the

   

bonds of register signing the same.

"

Orphan's courts in fixing commissions

   

of executors, to make no allowance for the

   

tax, said tax to be borne by and paid out

   

of commission and not by the estates of de-

   

ceased.

"

 

Every executor, in addition to oath now

   

required by law, to take an additional oath

   

diligently and faithfully to comply with

   

the provisions of the act, oath to be act-

   

ministered by registers of wills and re-

   

corded.

"
