consecutive years, it shall require an unanimous rote of
the board to re-elect him; and in case of a failure so to
re elect him, the said board shall proceed to the election
of some other competent person to discharge the duties
of the office of treasurer, according to the provisions of
this act.

CHAP. 4.

SEC. 4. -And be it enacted, Any act inconsistent or
repugnant to this act, be and the same is hereby re-
pealed.

CHAPTER 4.

Repealed.

An act authorising John Kendle to file a petition in the
orphans court of Washington County, for certain pur-
poses.

5, 1847.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That John Kendle be, and he is hereby au-
thorised to file a petition in the orphans court of Wash-
ington county, selling forth that a certain Jacob Boyer,
late of Washington county, died some years since, leav-
ing a will, wherein he appointed a certain John Boyer
his executor, with full power and authority to dispose
and make sale of his real estate; that the said John
Boyer, in execution of his trust, sold to the said John
Kendle a small tract of land, received the purchase
money, and distributed the same among the parties enti-
tled, as will more fully appear by accounts settled with
the orphans court of Washington county; that the said
John Boyer, executor as aforesaid, was duly authorised,
on the payment of the purchase money, to execute a deed
of conveyance for said tract of land; and that the said
John Boyer has since died without having executed said
deed.

SEC. 2. And be it enacted, That, if the orphans court
of Washington county shall be satisfied of the truth and
correctness of the matters and things to be contained in
the said petition as aforesaid prescribed; that then the
said court be, and it is hereby required to appoint a trus-
tee, to execute a deed of conveyance to the said John
Kendle for the said tract of land, which said deed when
executed, shall be good anil sufficient to all intents and
purposes as if the same were regularly executed by the
said John Boyer as executor.
