1811.

out agreeably to the intention of this act, the said
court shall direct the location of said road, and other
proceedings thereupon had, and the return of the sur-
veyor, to be enrolled among the records of Caroline
county, and thereupon and thereafter, such road shall
be deemed and considered to be a public road, and
shall be kept up and repaired as other public roads in
said county; Provided nevertheless, That the old road
so to be affected by this act, shall not be stopped up un-
til the new road shall be viewed, examined and receiv-
ed by two justices of the peace to be appointed by the
levy court of said county; And provided also, That
such new road shall be made and completed at the
proper expense of the parties applying for the same.

1811.

An act for the benefit of Charlotte H. Rownd, of
Somerset county.

Preamble.

WHEREAS, It is represented to this General As-
sembly by the petition of Charlotte H. Rownd, minor,
and the certificate of her sister Hetty W. Rownd,
that the said Charlotte H. Rownd is seized in fee sim-
ple, of and in one moiety of certain lands lying and
being in Worcester county, the houses on which are
in a state of decay; and that it would be greatly to
the advantage of the said minor to authorise the selling
of the said property: — Therefore,

may appoint a
trustee and or-
der the sale of
a moiety of said
land under a
certain provi-
sion.

BE IT ENACTED by the General Assembly of
Maryland, That the orphans' court of Worcester
county, shall have full power and authority upon ap-
plication of the said Charlotte H. Rownd, and being
satisfied that it is necessary, and will be of advantage
to the said minor to order the sale of a moiety of the
said lands lying and being in Worcester county, upon
such terms as the court may think proper, and to ap-
point a trustee for the purpose of effecting such sale;
Provided Her sister Hetty W. Rownd shall invest
the said trustee with powers to dispose of her part of
said lands at the same time and on the same terms.

Sale shall be
confirmed by
orphans' court.
Trustee shall
give bond.
Bond shall be
recorded, and
may be put in
suit.

AND BE IT ENACTED, That any sale made
by the authority of the orphans' court of Worcester
county under this act, shall be notified to, and con-
firmed by the orphans5 court of said county, before
the conveyance of the property shall be made, and the
trustee, before he enters upon the trust to him com-
mitted, shall enter into bond, with good security to the
state of Maryland, to be approved of by the said or-
