AN ACT to provide for the removal of persons
under sentence of death to the County or City
where the offence is committed.
|
|
|
Preamble.
|
WHEREAS, one of the objects of the criminal law
is defeated by inflicting punishment on offend-
ers in a place remote from the scene of the
offence, Therefore,
|
|
|
Removed cases.
|
SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That when a case shall be re-
moved for trial to another court, and the party
charged shall he sentenced to suffer capital punish-
ment it shall be the duty of the court pronouncing
the judgment to order the party sentenced to be
returned to the county or city in which the in-
dictment was found, together with a copy of the
record of the judgment, the case shall thereafter
be proceeded with, and the punishment inflict-
ed in the same manner in all respects as if the
party had been tried and sentenced in the county
or city in which the indictment was found.
