Proviso.

and unmarried, and that she may sue for and recover in her own name
all rents and profits of the said estate or any part thereof: Provided,
that nothing herein contained shall be construed to effect or impair
any right to the said estate, acquired by the said James P. Boyd, or
any other person or persons before the passage of this act.

Preamble.

, CHAPTER 3.

An Act for the benefit of the Children of Samuel Colston, of Talbot county.
Whereas, It has been represented to the General Assembly of
Maryland by the petition of Samuel Colston, of Talbot county, that
several years past he intermarried with a certain Rebecca Catrop, of
said county, who was seized in fee simple of a parcel of land lying and
being in said county, and that the petitioner and the said Rebecca liv-
ed together for several years as husband and wife, and that he had
several children by the said Rebecca, seven of whom are now living,
and two of them only of full age, and that the said Rebecca has not
long since departed this life, and that the said petitioner is now tenant
by the courtesy of the said land; and the petitioner further represents
that a great proportion of the said land is wood land, and that the
wood and timber would be rather benefitted than injured by a sale
occasionally of such as might be in a state of decay, and the petition-
er further represents, that without the aid of the proceeds of the sale
of such decayed or decaying wood or timber he is not able in a pro-
per manner to educate his said children—Therefore,

Sec. 1. Be it enacted by the General Assembly of Maryland, That the
orphans' court of Talbot county be, and they are hereby authorised and
empowered to enquire into the premises, and to authorize the said
Samuel Colston, in their discretion, to cut and sell such quantity of
said decayed and decaying wood and timber belonging to the said
land as they may deem necessary, and that the proceeds of the sale of
such wood or timber be applied to the support and education of the
children of the said Samuel Colston.

2. And be it enacted, That the said Samuel Colston shall ac-
count to the said orphans' court in such manner and at such times as
the said court shall direct, for the proceeds of sale of such wood or
timber as may be made under the authority of this act.

:. chapter 4.
An act for the benefit of James Burns, of Frederick county.
Whereas, James Burns, of Frederick county, emigrated to and
settled in this state, and since his emigration and settlement as afore-
said, has acquired real property therein, and his title to such proper-
ty, from his not having been naturalized agreeably to the laws of the
United States, may be called in question to his great detriment and
injury—Therefore,

Right vested.

Be it enacted by the General Assembly of Maryland, That the title
to the real property of him, the said James Burns, heretofore intend-
ed to be vested in him, his heirs and assigns, by purchase or deed
fairly obtained, be and the same is hereby amply and fully vested in
him, the said James Burns and his heirs, in fee simple, to all intents
and purposes as if he had been naturalized agreeably to the said laws
at the time of the said purchase, and when he received his said deed:
Provided, always that nothing in this act contained shall in any man-
ner defeat or affect any right, title or claim to the said property, or a-
ny part thereof acquired or prosecuted by any person or persons what-
