the persons so summoned and so qualified, shall thereup-
on proceed to assess and value the damages accordingly,
of winch the said commissioners or sow one of them,
shall have given at least five days notice, and such in-
quisition shall be final and conclusive between the par-
ties; and in assessing the damages the jury shall take
into consideration the conveniences and inconveniences,
the advantages and disadvantages, if any, arising to the
proprietors of the land over which the said road may

pass; Provided, That in such appeals from the valuations
and assessments of damages made by the commission-
ers, shall the valuations and assessments of the said com-
missioners be confirmed by the jury by this section di-
rected to be summoned, the party or parties appealing

3. AND BE IT ENACTED, That the said com-
missioners shall not open the aforesaid road through any

building, garden, orchard or meadow of any person,
without first obtaining his, her or their consent in wri-

ting.

commissioners shall receive for their services two dol-
lars for each day's necessary attendance, to be paid by the
said Anthony Thompson, William M. Robertson,
Charles Jones, Horatio Jones and Ezekiel Fitzchew.

CHAPTER 130.

An act to prevent Geese and Swine from going at large
in the town of Rockville, in Montgomery county.
Section 1. BE IT ENACTED by the General Assem-
bly of Maryland, That from and after the first day of
March next, it shall and may be lawful for all and every
person, or persons, to take up and impound any geese
and swine, which may be found going at large in the said
town, and the owner shall be obliged to pay, on reclaim-
ing the said swine or geese, at the rate of fifty cents for
an hog, and fifty cents for every six geese, provided the
said geese or swine shall belong to any of the inhabitants
within its limits.

An act to fix and regulate the quality of silver plate,
manufactured and sold, or offered for sale, in the

city of Baltimore, and for other purposes.

Section 1. BE IT ENACTED by the General Assem-
bly of Maryland, That from and alter the first day of
August next, no silversmith, or other person whatsoe-
ver, shall sell, exchange, or expose or offer to sell or ex-
change, in the city of Baltimore, any silver vessel, place
or manufacture of silver whatsoever, over the weight of
five penny weights, and less in fineness than eleven oun-
