and empowered to view and assess the damages if any,
which in their judgment the said Nicholas Hull shall have
sustained by the locating and making of a road through
his lands, which was laid out in pursuance of an act
passed at November session eighteen hundred and eight,
entitled, An act to open and establish a road from near
the old glass Works called New Bremen in Frederick
county, to intersect the Baltimore and Frederick-Town
turnpike road, at the town of New-Market in the said
county, and that the said commissioners or a majority of
them shall make out, and return under their hands and
seals a fair valuation of the damages aforesaid to the
levy court of Frederick county, who shall assess and
levy the same on the assessable property of said county,
to be collected as other public assessments are collected,
and paid over to the said Nicholas Hall, his executors, ad-
minstrators or assigns.

2. AND BE IT ENACTED, That the said com-
missioners before they act as such shall take an oath be-
fore some justice of the peace, that they will without fa-
vor or affection, prejudice or partiality, execute the pow-
ers vested in them by this act

CHAPTER 91.

A supplement to the act entitled, an act for the preserva-
tion of the breed of Fish.
Section 1. BE IT ENACTED by the General Assem-
bly of Maryland, That it shall not he lawful for any per-
son or persons to erect pots or other devices in the river
Susquehanna, tor taking of fish, whereby the slats in the
bottom thereof shall be more than one and an half inch
wide, or any two of them shall be put or placed closer
together than three quarters of an inch, with the square
edges taken off, so as to round the top of the same, to
prevent the distinction of small shad, nor shall any fish-
ing dam be erected that will impede the navigation of the
said river.

dams.

2. AND BE IT ENACTED, That if any person
or persons whatsoever, from and after the first day of
May next, shall erect any fishing dam so as to impede the
navigation of the said river, or ereet fishing pots, or oth-
er devices whatsoever, for taking of fish within the river
aforesaid, wherein the bottom slats shall be more than
one and an half inches wide, or placed closer togeth-
er than three quarters of an inch, or not rounded on the
top part, or shall be aiding, assisting or abetting in
building, setting up, repairing or maintaining such fish
dam, or such fishing pots, or any other devices whatsoe-
ver, for taking of fish in the river aforesaid, by which
young shad may be taken, destroyed or obstructed from
coming down the said river, every such person or per-
sons so offending contrary to the true intent and meaning
of this act, being legally convicted thereof by the oath of
