CHAPTER 118.

. An act for the relief of James P. Heath of the City of
Baltimore.
Sec. 1. Be it enacted by the General Assembly of Maryland,
, That the judges of Baltimore county court, be and they are here-
by authorised and directed, to extend to James P. Heath, of the
city of Baltimore, the benefit of the act of assembly, passed at
November session, eighteen hundred and five, entitled, An act for
the relief of sundry insolvent debtors, and the several supple-
ments thereto, without requiring the said James P. Heath to pro-
duce the assent in writing of two thirds in amount of his credi-
tors, as is prescribed by the provisions of the said act, and
supplements thereto.

CHAPTER 119.

, An act to provide for the Recording of certain Deeds and
other Papers.
Sec. 1. Be it enacted by the General Assembly of Maryland, That
wherever the clerk of any county court in this state hath died,
or shall hereafter die, leaving in his office any deed or deeds, or
other paper or papers, other than judgments or proceedings in
court, and which are required by law to be recorded, and have
not been entered in the record books as required by law in the
life-time of the clerk who received the same, it shall be the duty
of the clerk of such county, for the time being, to record the
same, as of the day on which the said deeds or other papers shall
appear by indorsement thereon to have been received in the clerk's
office to be recorded; and the clerk who shall so record the same
shall affix thereto the name of the clerk who received the same,
and also his own name, and the said deeds, and other papers, when so
recorded, shall be of the same force and effect as if the same, had
been duly recorded in the record books on the day on which they
were so received.
2. And be it enacted, That the clerk so recording the said deed
or deeds, or other papers, shall be entitled to the same fees as
are now allowed by law for similar services, to be paid by the
party at whose request the said deed or deeds, or other papers,
shall be recorded.
3. And be it enacted, That wherever the fees in the cases be-
fore mentioned have been paid to any deceased clerk, his execu-
tors or administrators, for recording any such deed or deeds, or
other paper or papers, the person or persons paying the same for
recording under this act, shall be entitled to recover from the
executors or administrators of such deceased clerk, so much
money as they shall respectively pay, in the same manner as
small debts are recovered before a single justice of the peace ;
Provided always, that no clerk, shall be bound to record any such
deed or deeds, or other papers, unless his fees therefor shall be
first satisfactorily secured to him.
