FACTORY PERFORMANCE OR OTHER WORKING OR EM-
PLOYMENT REQUIREMENTS CONCERNING STATE EM-
PLOYEES.

Sec. 2. And be it further enacted, That this Act shall expire
automatically and with no further action required by the General
Assembly of Maryland, on January 1, 1958.

Sec. 3. And be it further enacted, That this Act is hereby declared
to be an emergency measure and necessary for the immediate
preservation of the public health and safety, and having been passed
by a yea and nay vote, supported by three-fifths of all the members
elected to each of the two Houses of the General Assembly of Mary-
land, the same shall take effect from the date of its passage.

CHAPTER 28
(Senate Bill 3)

AN ACT to repeal and re-enact with amendments Section 81 of
Article 97 of the Annotated Code of Maryland (1951 Edition),
title "Weights and Measures", sub-title "State Apple Commission",
making it a misdemeanor when an apple grower fails to make a
report to the State Apple Commission, or when he fails to keep
records of apples sold, or when he fails WILFULLY to pay the
excise tax on apples sold.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 81 of Article 97 of the Annotated Code of Maryland
(1951 Edition), title "Weights and Measures", sub-title "State Apple
Commission", be and it is hereby repealed and reenacted, with
amendments, to read as follows:

81. (Penalty.) It shall be a misdemeanor for any grower know-
ingly to fail to make a report to the Commission as provided in Sec-
tion 75,
to report falsely to the Commission the quantity of apples
sold by him during any period, to fail to keep records as required by
Section 77,
[or] to falsify the records of the apples sold by him, or
to fail
WILFULLY to pay the tax imposed by Section 74, and upon
conviction thereof such grower shall be subject to a fine not exceed-
ing $500.00.

Sec. 2. And be it further enacted, That this Act shall take effect
on June 1, 1957.

Approved February 1, 1957.
