CHAPTER 297

(Senate Bill 224)

AN ACT to add new Section 93A to Article 52 of the Annotated
Code of Maryland (1951 Edition), title "Justices of the Peace"
sub-title "Trial Magistrates System", said new section to follow

immediately after Section 93 thereof, allowing trial magistrates
in Harford County to fix certain condition for the suspension of
sentences.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 93A be and it is hereby added to Article 52 of the An-
notated Code of Maryland (1951 Edition), title "Justices of the
Peace", sub-title "Trial Magistrates System", said new section to
follow immediately after Section 93 thereof and to read as follows:

93A. (Jurisdiction-Parole PROBATION,) In Harford County
for those cases in which a sentence to jail or to the Maryland House
of Correction has been suspended, a Trial Magistrate may fix certain
conditions for the suspension of sentence
AND enter such conditions
upon his docket as part of the sentence. , and place the convicted per-
son under the supervision of the Department of Parole and Probation.
The trial magistrate or any duly qualified substitute or successor may
hear charges laid by the Department of Parole and Probation,
STATE'S ATTORNEY, issue a warrant for return to custody of any
violator and may revoke said suspension, after reasonable notice and
hearing, upon substantial proof that any material condition of the
parole,
PROBATION, as shown by the docket entries in the original
case, has been violated. Any person whose parole
PROBATION has
been revoked under this section shall have a right to an appeal to the
Circuit Court for Harford County within ten (10) days from the
date of revocation and such case shall be heard without a jury like
other appeals from trial magistrates.
BY SAID CIRCUIT COURT.
The defendants in such hearings shall be entitled to counsel.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1957.
