ARE AVAILABLE FOR THE PURPOSE, TO THE END THAT A
CONTINUOUS SYSTEM OF PRIMARY HIGHWAYS WILL RESULT
AND THAT SECTIONS OF SUCH PRIMARY HIGHWAYS WILL
NOT REMAIN IN AN UNCOMPLETED CONDITION, AND TO THE
FURTHER END THAT ALL OF THE PLANNED HIGHWAY
IMPROVEMENTS PROGRAMMED FOR THE SEVERAL AREAS
AND COUNTIES WILL BE COMPLETED OR UNDER CON-
STRUCTION WITHIN THE FIVE YEAR PERIOD NEXT SUC-
CEEDING THE EFFECTIVE DATE OF THIS ACT. THE COM-
MISSION SHALL PROCEED WITH THE CONSTRUCTION OF
THE PRIMARY HIGHWAYS IN SUCH MANNER THAT THE
HIGHWAYS WILL BE CONSTRUCTED SO AS TO PROVIDE
CONTINUOUS CONSTRUCTION AND AN EVEN FLOW OF CON-
TRACTS IN THE COUNTIES AND SEVERAL AREAS OF THE
STATE UNTIL THE PROPOSED HIGHWAY PROJECTS ARE
COMPLETED. AND, FURTHER, THE COMMISSION SHALL
NOT MAKE POLICY DETERMINATIONS RELATING TO HIGH-
WAY LOCATIONS, SCHEDULING, SUBSTITUTIONS AND PRI-
ORITIES WITHOUT FIRST CONSULTING AND CONFERRING
WITH LOCAL AREA AND MUNICIPAL GOVERNMENT
OFFICIALS THE MEMBERS OF THE LEGISLATIVE DELE-
GATION FROM THE COUNTY AFFECTED AND THE MEM-
BERS OF THE GOVERNING BODY OF SUCH COUNTY AND
THE MUNICIPAL GOVERNMENT OFFICIALS OF ANY COM-
MUNITY AFFECTED THEREBY. The terms "first four program
years", "second four program years" and "third four program years"
as used in Sections 201 and 205 of this Article do not necessarily
mean calendar or fiscal years, but indicate the length of time required
to complete the miles of proposed construction and reconstruction set
forth in the document entitled "Road Construction and Reconstruc-
tion in the Proposed Twelve Year Program" in the several counties
in the State during the first four program years, the second four
program years and the third four program years of the entire Twelve
Year Program. The terms "Twelve Year Program" and "Twelve
Year Construction and Reconstruction Program" as used in this
Article do not necessarily mean twelve calendar or fiscal years but
indicate the length of time necessary to complete the miles of con-
struction and reconstruction provided in the aforementioned docu-
ment entitled "Road Construction and Reconstruction in the Pro-
posed Twelve Year Program".

205. Construction in several counties of the State.

The Commission shall, from the funds appropriated by this sub-
heading, construct and/or improve in the several counties of the
State, the total number of miles of road as said road mileage is
totaled in the hereinafter described document, with the following
exception: (1) The said total mileage of construction and/or im-
provement shall be five percent (5%) during said twelve year period,
and within ten percent (10%) during the first four program years,
the second four program years or the third four program years,
provided the total number of miles prescribed in the hereinafter
described document shall be within the five percent (5%) limitation,
as said total number of miles is set forth for construction and/or
improvement. Provided, however, that in those counties in which
the percentage of variance is higher than the average percentage
of variance among all the counties, at the end of the first four pro-
