first such area shall not exceed a distance of 100 yards for each land
owner. In the event that there shall be more than one such private
bathing beach belonging to the same land owner, or one private bath-
ing beach which extends for a distance of more than 100 yards, the
Commission of Tidewater Fisheries may, in their discretion issue a
numbered permit for more than one such private beach or for an
area in excess of 100 yards. Any extended area or areas shall be
marked and the areas designated as the Commission of Tidewater
Fisheries shall prescribe in its rules and regulations, or

(5)  on Sunday, or between sunset and one-half hour after sunrise
on any other day, or to land soft shell clams before sunrise or later
than one (1) hour after sunset, or

(6)  within 100 yards of the mean low water mark of any shore
line, or

(7)  between October 1 and the last day of the wild fowl hunting
season, all of the waters of Kent County as defined herein except all
that area of the Chesapeake Bay waters known as Swann Point Bar,
extending northward from Navigation Buoy No. 3 to a line 600
yards southward of Swann Point, excepting and excluding all areas
within fifty yards of natural oyster bars as shown on published charts
of 1906-1912 on record with the State Department of Tidewater
Fisheries.

(c)  Manner of Adopting and Publishing Rules and Regulations.
No such rules and regulations of the Commission shall become effec-
tive until said Commission has held a public hearing. Such public
hearing shall be advertised as to time, place and purpose, and such
advertisement shall appear in at least one newspaper, local to the
county for two successive weeks in advance of such hearing. After
such hearing, and upon adoption by a majority of the members of
the Commission of Tidewater Fisheries, and following compliance
with the provisions of Section 9, Article 41 of the Annotated Code
of Maryland (1957 Edition), such rules and regulations shall be pub-
lished for one (1) week in the newspapers bearing notice of the
hearing, and thereafter shall have all the force and effect as of law.

(d)  License to Operate Hydraulic, Mechanical or Other Dredge.
The rules and regulations adopted by the Commission of Tidewater
Fisheries shall provide that any person, desiring a license to operate
a hydraulic, mechanical, or other dredge for the catching or taking
of soft shell clams, shall be the owner of his boat and a resident of
the county for one year prior to his application, and each member
of the crew of his boat or rig, must be, for a period of one year prior
to his application, a bona fide resident of the County in which he
wishes to operate such dredge, that any license, issued by the Com-
mission of Tidewater Fisheries, shall specify the County in which
such operation is authorized, shall be valid for twelve (12) months
from July first to June thirtieth, and the fee therefor shall be Fifty
Dollars ($50.00).
A PROPELLER GUARD SHALL BE USED AS
MAY BE REQUIRED BY THE COMMISSION OF TIDEWATER
FISHERIES. THE COMMISSION OF TIDEWATER FISHERIES
MAY REQUIRE SUCH MODIFICATIONS TO THE HYDRAULIC
CLAM DREDE AND/OR LICENSED DREDGE BOATS AND
RIGS AS MAY BE DEMONSTRATED TO BE IN THE PUBLIC
INTEREST THROUGH RESEARCH OF THE DEPARTMENT
